ILR (LR)

Post by ameer1504 » Fri Aug 16, 2019 12:50 am

Hello every one here

I am having very tricky questions here if some one can help me I would much appreciate

As I am eligible for ILR under 10 years route I want to give some brief history to understand my case I came as a student here in uk , switched to psw applied tier 1 which was refused later on switched to tier 2 general every thing was running normally until May 2018.

After that I tried to apply jobs but couldn’t got success for it and now I am on due for ILR ( 10 years route )

My question is here what do I need to put in the place of employment details ??

Pls advise me accordingly

What happened with your tier 2 employment and/or sponsor??

How have you been supporting yourself since May 2018 if you have not been working for the tier 2 sponsor?

Are you sure HO had or has your correct address and that your tier 2 visa was not curtailed last year already??

They might have if they had an old address because you didn't update them if you moved. Your previous sponsor would have informed ho within 10 days of your last working day. Curtailment letters rarely take more than a year to get sent.

Useful to answer all the questions I have asked as they are relevant.

Have you been working in any way since may 2018??

I would suggest you do a subject access request to make sure that your visa was not actually curtailed as you would then be an overstayer and ineligible for long residence ILR.

The point is, you hold an employer sponsored visa and you are no longer working for the employer, therefore your visa conditions are no longer met. Highly unlikely that HO would just forget about you if the company is no longer a sponsor following liquidation.

You need to answer all the fundamental questions asked by CR001 for you to receive correct advise or else you might run into trouble. It is very rare HO would not have been aware of the liquidation of the company, if not you need to explain your circumstances properly as the concern will be how you have been surviving since the company’s insolvency.
