Spouse of British for over three years now!

Post by luna247 » Sat Aug 17, 2019 3:24 pm

I have Leave to remain for 5 years now , I got married to a British for over three years now and the leave to remain Visa will be expiring by Jan, 2020.

My question is can I apply for indefinite Leave to remain as spouse of British now for over three years and we have two lovely daughters now that also British.

I will highly appreciate your kind advice.
Regards

What is your immigration history and exact visas held for 5 years?

You cannot apply ILR now unless you have completed your 10 years of legal long residence.

So you have FLR(FP) 10 year route then that is what you are on. Simply getting married to a British citizen doesn't change your visa route unless you specifically apply for the 5 year route FLR(M), which also resets your 5 year clock to zero for ILR.
