Eu retention right

Hi all,
I need help I married in2013 I got my five year stamp in 2016 now I broke up with my Mrs she is working here in Ireland and we are going to file divorce in October from latvia we going to sign paper and come back and divorce take one month.
She is going to back home in January after finishing divorce . Where I’m standing can I eligible for Eu retention ?

My concern is I fullfill the requirement of marriage last for three years and living in state for one year and by the time of divorce she must be exercising Eu treaty right. She is working full time.
Only big confusion is we are going for one day to her home country to file divorce and come back she will be working until divorce proceeding is going .
Just wondering I will be eligible for Eu retention right ?

Yes if you have decree of divorce on hand you are eligible to apply retention of rights..

I'm worried for beeing on NO status could impact your application. these days they are going little strict with this.

The way I file the divorce it’s nothing wrong with that ?
And do you know any solicitor who done that before ?

Nope, almost every one do that way.. even I did same divorce from my wife's country..

there are lots of solicitor, its not about solicitor its about what documents you can provide..

What has your wife done since 2013 when you married? Was she continuously working from 2013 to 2018.

Yes u are right but at the moment my concern is different I’m getting divorce going to her country come back and then sending all my documents to Inis. So is that right way to do ?

If she left to do divorce that may have implications.

It seems you may qualify for EU 3.

No but she is not leaving the state untill we get decree of divorce in hand she is going only to sign paper and come back next day and she will be working till end of December is that keep me safe for retention?

I did the same, I get divorce from her country took one month and we get divorce by post. My wife also went for just sign the papers,
then I applied retention took 9 months retention was approved problem comes when you applied Eu3 because they will do investigate especially Retention case or delay response from DOJ.

I'm just sharing my experience you could be lucky passed through all bridges.
