Tier 1 Exceptional Talent Visa - Dependent ILR

Hi,

I'll appericiate some help on following queries:

Context: I am currently on Tier 2 ICT visa since jun 2015 (End date on 21 sep 2019) with my depedents. Recently i received Tier 1 ET stage 1 endorsment. I'll be applying for Tier 1 ET 2nd stage along with my dependents application.

Questions:

1. I understand that as a main applicant i can apply for ILR post 3 years (by some time year 2022); however my dependents needs to wait until 5 year (by some time year 2024). So the question is can i apply indiviually for ILR post 3 year completion ? if yes, how my dependents Tier 1 ET dependant status is handled? do that continue to be on dependent visa ? if not, do i also need to wait for 5 year to apply together ?

2. Second questions is on ILR qualified duration. For example, if i switch to Tier 1 ET visa within country (UK) 1 month before my Tier 2 ICT expire (for 5 year duration), how the 5 years calculated from the date i received my decision on Tier 1 ET visa or from the Expiery of Tier 2 ICT visa ?

1. Dependents can stay on their current visa until they qualify for ilr if you ilr based on tier 1. No need to change their visa category. They need 5 years pbs dependent residence to qualify for ilr.

2. It starts counting from tier 1 issue date.

Just to clarify..so If i get the ILR in 3 years, my dependents continue to be on Tier 1 PBS ET dependent visa untill 5 years ?

Considering above scenario, When we apply for Tier 1 ET visa (Stage 2) can i apply for 3 years validity & for them 5 years validity ? is it possible doing this all applications together or do we need to do seperate application. i.e. 3 years application for myself & then 5 years for them.

This will allow to save some cost on IHS fees :)

Not possible. A PBS dependent will get a visa in line with your visa expiry date, regardless of applying together or separately for dependents.
This will allow to save some cost on IHS fees :)

ah in this case we all have to apply for 5 years visa for my dependents to be eligible for ILR.

So overall i need to pay for 5 years IHS although i can get the ILR for myself in 3 years ..hmmm..damn :x

Or you simply apply for 3 years for all of you and then extend their PBS Dependent visas once you have ILR. They will apply and get a 3 year extension.

Yup ..thats the other option i thought ..but in that case the overall cost would be more as need to pay there visa fees again (£608 x 2).
