what happens to my work permit

what happens to my work permit

Dear Friends,

I have a query on my status change from work permit to tier-1.

I shall be travelling to uk on my work permit from company X.
I shall apply for tier-1 visa upon my arrival in UK.

Can I still work under the work permit of company X?.
Will company X get to know about my status change?.

Any word of caution / advice in this matter :-).

Hi,
I think you probably will have to work here for a period of 6 months before you apply for the change from work permit to tier 1. Also the company would not be able to find if you have a tier 1 or not, Even if they come to know you will not have any problem as the company will only be happy to retain you as they will not have to incur the additional cost on work permit extension etc.
Thats how i have seen the trend is.

Just recheck again abt the 6 months time period before you switch to tier 1.

i will check on the 6 months thing with the consulate as it is not mentioned anywhere in tier1 guidance.

also, when we apply for tier-1 in UK, can i show the maintanence fund in my indian account?.

Yes you can show the maintenance funds in your Indian bank account.

Yeah. Abt the 6 months thing, I havnt actually seen that mentioned in the Tier 1 general guidance. But I hav heard this from consultants or the blogs. Please leave the information you get from the consulate in this regard so that it will be usefull for others.

Hi,

I switched from WP to Tier1 and did not find this criterion regarding 6 months anywhere. (I was in UK for 1 year though)
Only related thing was that if you want to get 5 points for UK experience, you should have earned atleast GBP 16K or so in UK.

Effect on Kid's work permit (dependant) visa

I am in UK on work permit sponsored by my company. My dependant is on dependant visa.

In case I switch my visa to Tier1 visa, what happens to:

- my work permit visa (Will that get cancelled automatically or will I be having both the visas)?

- my dependant's visa (Can the dependant still stay in UK)?

1. The rule of thumb is that any new endorsement in your passport supercedes an existing / current endorsement. In light of this, a Tier 1 leave to remain will invalidate your current leave as a WP holder.

2. Your dependents can make an application to switch to Tier 1 dependent category at the (same) time as you make a Tier 1 application. As suggested earlier, read through the appropriate policy guidance.

Just a wicket question, I have my WP till jan'09 and have applied for Tier 1. If it gets rejected(hope this doesn't happen) will my WP becomes invalid.

I know this is a stupid question, but please bare with me....

It is not a rule of thumb, which is "a rule for general guidance, based on experience or practice rather than theory" according to the OED.

It is in the Immigration rules about applications for variation of leave to remain.

If you get another type of leave to remain, your leave has been varied (the duration and/or conditions have been varied).
