Difficulties in Tier 2 Dependent Visa

Hi All,

We are currently facing issues for the single parent dependent visa for the children.
The cases we have examine are below:
    Single Parent (No custody)
      Separated Parent
        Single parent (With custody ) (Not sole)
          Separated Parent ((With custody ) (Not sole)

          This is has mainly the issues for the applications Caribbean regions.

          The home office has rejected the applications under sec 319 (H) for the Immigration rules.
          When home office says:
          f) Both of the applicant’s parents must either be lawfully present (other than as a visitor) in the UK, or being granted entry clearance or leave to remain (other than as a visitor) at the same time as the applicant or one parent must be lawfully present (other than as a visitor) in the UK and the other is being granted entry clearance or leave to remain (other than as a visitor) at the same time as the applicant, unless:
          (iii) there are serious or compelling family or other considerations which would make it desirable not to refuse the application and suitable arrangements have been made in the UK for the applicant’s care.

          What proof's are can submit ? Has anyone got any successful visa in such case?

          You need to explain your circumstances more if you expect any useful advice.

          If you do not have sole responsibility for the child, you are unlikely to be successful with a child PBS dependent visa.

          Hi,

          Thank you for your response.

          What are the chances of the Visa being approved after having sole custody of the child?

          Is there any authorized link on the home office website for this reference?

          Hi ,

          Thank you for the Link.

          After reading through the link - I believe
            the best plan would be to have the below:
            • Consent from the parent starting that he has no relation with the mother or child.
              Letter from neighbor
              Letter from church ' father
              Letter from medical practitioner who has been treating the child
              Letter from school conforming the parents meeting, school fees were paid by mother.

              Do you think this would suffix? can there be any other documents paperwork that can help?
