Dear CR001,

I am in a similar situation.

Our child is 5 years old. Both parents and child are ILR holders for more than couple of years.

1. Please do not tag your questions onto other members topics. It is unfair to posters and creates confusion when members respond.

2. Note that we do not all have sight of the online form. So state the options you are given on the MN1 form.

Note that if your child was born abroad, they can only apply for citizenship if either parent is also applying.

Hi CR001,

Sorry abt that.

The online form allows adding an applicant under 18. I believe this means I do not need to apply via form MN1
The online form has this question:
Choose which category to apply under. You are a child under 18 and:
Options:
1:You were born in the UK
2:You were born outside the UK

It does not ask for the category under which we are applying (like form MN1 asks)

When I read your post, I got confused what the "other" option you referred to, thats all.

Its option 2 if the child is born abroad and its at the discretion of the home office.

Thanks, I have a question about the English language requirement for my wife.

She had done the English test in 2015 and used it for ILR application.

The HO website (https://www.gov.uk/english-language/app ... ifications) suggests
You can still use a B1 level qualification that you took more than 2 years ago in 2 situations
Applying for citizenship
You can use a B1 level qualification that’s run out if you’re applying for citizenship and it was accepted when you settled in the UK.

It does not matter if the B1 level test you took is not on the current list of recognised tests. You do not need to take another test.
The online application form's "Documents" section needs us to submit the proof
Certificate proving you have a speaking and listening qualification in English at B1 CEFR or higher
You must include one of the following:
English language test certificate (minimum level B1 of the CEFR or equivalent)
your passport from a majority English speaking country
a letter from a medical professional explaining why you should be exempt from the English language requirements due to your physical or mental condition
your graduation certificate showing you have an academic qualification equal to a Bachelor’s, Master’s degree or PhD in the UK
If you are providing your graduation certificate, UK NARIC must confirm the course was taught in English, the UK or in a majority English speaking country (excluding Canada) and be equivalent to a UK degree.

If you do not have your certificate you must send either a reference or transcript (on official letterhead paper) from the academic institution that shows your:

name
course title
title of award
date of award (or when it will be awarded)
confirmation the institution cannot reissue the original certificate (if lost)

Does it mean that we "must" submit the Certificate even though it is expired?
Do I need to write any cover letter/notes explaining this to HO?

If anyone else had a similar situation and can shed some light on how to proceed that would be highly appreciated.

The certificate has expired, but was used in the ILR (successful) application.

British Citizenship questions

Dear all,

I will appreciate if the forum experts can provide me some guidance on British Citizenship application.

My situation:

We are a family of 3 originally from India. All of us have ILR granted in 2015 in the UK.

Immigration history:
Father : 1st entry into the UK using Tier-1 in Oct 2010.
Mother: was Tier-1 dependent and entered the UK in 2011
Child: Entered the UK as Tier-1 dependent as he was born in India in Jan 2014.
We reside in the UK.

We are now looking to apply for British Citizenship.

We meet the absences criteria, and ‘Presence in the UK at the start of the qualifying period’ requirement.

I have following questions.

1: Can my child apply for Registration as British citizen at the same time both parents apply online?

2: Do the parents need to get naturalised before child is eligible to apply?

3: If our child is eligible, under what rules can we apply for our child. Is it under discretion of Home office?

4: Father has a Degree taught in English, in India, but no UKNARIC certificate to prove the degree is equivalent to a UK degree. Father previously used this degree for Tier-1 and ILR application grant. But the Points based system was abolished in around 2016.
Now father has a valid English language test certificate from Trinity.
The online application form has a question: ‘Do you have a degree that was taught in English’

Is it okay to say ‘NO’ and instead provide the approved English test certificate?

5: Does adult applicant need to declare a PCN in the naturalisation form? Penalty charge notice received 26/07/2018 for overstaying in a shopping complex by 30 minutes?
This was paid in time and got the early payment discount as well.

6: Does the professional referee for child need to have known them for 3 years.
The online application for for minors asks “know or have known the applicant personally for more than 3 years”
But the paper form MN1 does not. Is this a possible error in the online form?
The GP and health visitor have refused to act as our child's referee. The school knows our child for just 1 year or so.

7: Can someone point me to the referee requirements for children under 18 please?

8: The online form has a checklist. In that I get a checkbox item like so:
`If 'the child' told us that their parent is a British citizen then you must provide us evidence of their citizenship. This could include their British passport, a certificate of citizenship or their birth certificate.`
I know it says 'if', but we have already mentioned in the form that we aren't British passport holders and its still asking us this question. The online form won't proceed unless I select the check box.

1. Yes, if the child holds ilr.

2. No.

3. Yes, section 3(1) at HOs discretion. There is no other option for children born abroad.

4. You need UK naric English and comparable assessment OR the English B1 test. If you are using the English test, you tick NO to the degree question. Ho don't care what your qualifications are.

5. No.

6. No, buy it should be someone involved with the child.

7. The professional referee should be someone engaged with the child, or teacher, religious minister, pharmacists etc etc.

8. Simply tick the box. It does state IF.

Please can experts advise on following:

Is either parent's birth certificate required for registering child as British Citizen?

I am submitting both parent's Indian passport as I am applying online for all three of us (me, wife & child) together.
