New employer not accepting my permanent residence card attached to expired passport

Post by andtozpir » Fri Sep 27, 2019 8:35 pm

Hi All,
I'm married to an EEA national living in the UK for 12 years and working during all this time continuously.
I recently found a new oportunity and received a job offer which I accepted.
Today I sent my resignation letter and went to the new employer with my documents but they are not accepting my permant residency card attached to my old and expired passport. The residence card is valid until 2023 but the passport expired in 2013.
This was a real surprise to me as I changed jobs 3 times since 2013 and did not have this problem before. I was unaware this would be a problem.
The new employer also said if I can provide written evidence of my elegibility to work in the UK from the Home Office it would be accepted temporarily until I get the new biometric residence permit. After researching online I found the biometric residence permit takes 6 to 8 weeks or longer to be processed and the employer cannot wait all this time.
Can someone please suggest if anything can be done in my situation? I am really stressed and worried I may become unemployed after living and working in the UK for such a long time.
Regards,
ATP

Prove your right to work in the UK
You cannot use a valid visa in your expired passport to prove you have the right to work in the UK. You must replace your visa with a biometric residence permit.

Thanks for your reply. would you how to apply for the biometrical residence permit? I've been searching the home office website but cannot find where to start an application. Do you know if there is anyway to speed up the process to obtain the BRP?

If you want a faster decision you can pay an extra £800 for the super priority service. You’ll get a decision:
•by the end of the next working day after your UKVCAS appointment if your appointment is on a weekday
•2 working days after your UKVCAS appointment if your appointment is at the weekend

Working days are Monday to Friday, not including bank holidays
