Confirmation from EU treaty

Please have anybody encounter this none EU who is married to an EU have a baby with another person and the none EU have spent more than 3years before the baby was born but the passport office confirmed the baby is qualify through none EU but they have to verify something from EU treaty again . just don't know what again they want to verify....and the none EU still with the EU married too...
