Spouse visa application

I’m just looking for opinions

I came to Uk as a minor I was 15 applied for asylum got refused
Then I applied for a spouse visa with my gf then we notified the council we did the paperwork they allowed us to get married we got married
Now she is my wife and she is British citizen and I’m albanian
I’ve lived with her when I lived in England have bills, she has her payslip which reaches 18:600
At the end they refused my case
The reason they stated bcos I came here as a asylum seeker and home office think that I married my wife so I could stay in England
I told my Soliciotor to appeal it
We appealed it then somehow I had to come back home due to some reasons I spoke to my soliciotor then he said to me I could go back home and apply from there we did the paperwork in Uk then I went to the ambassy where they do the paperwork here in Albania everything went okay now I’m waiting for the answer
I want to state that I left voluntary have no criminal record
And the home office stated in the refusal that they relationship is real and that we married by law in the uk but they just want me to go and apply from Albania to show that you’re not married just to stay in Uk
Now all done waiting for answer
I payed priority visa so they said I will have an answer in 30 working days wondering can it be faster and what is your guys opinion thank you

Hey
Can anyone help me
I’ve applied for spouse visa from Albania
Given home office all the paperwork
6 month payslip from work
6 month from bank statement
And letter from work
Tenancy agreement
And every other proof
Problem is that wife had to leave the job due
To some issues and now aparantly they can call the job
I spoke to her manager and said she can only tell
Home office that she working here but if they
Dig deeper she will tell them
But the work she use to work there it’s for a major
Home care it’s not “family business “ it’s proper company
I’m wondering if home office will call

Also all her payslips are from one job
And it’s one of the largest uk home care

That would be lying to HO and could result in a refusal and deception.

There are other ways HO can check her employment with the government departments.

But she has started work somewhere else already would that be fine
Case been submitted on the 29th of March and it’s fast track she has already got a job starting on Monday would that help

Hello everyone if you could give an opinion please
I was refused today 15:5:2019 and appealed today
I meet these requirements

Eligibility
You meet the eligibility requirements of Section E-ECP of Appendix FM.
Eligibility Relationship Requirement
You meet the eligibility relationship requirement of paragraphs E-ECP.2.1. to 2.10.
Eligibility Financial Requirement
You meet the eligibility financial requirement of paragraphs E-ECP.3.1. to 3.4.
Eligibility English Language Requirement
You meet the eligibility English language requirement of paragraphs E-ECP.4.1. to 4.2.


Got refused for this
In light of the above I am satisfied that you have previously contrived in a significant way
to frustrate the intentions of the Immigration Rules by
(i) overstaying;
(iii) being an illegal entrant;

Has this happen to anyone, and if so what’s you’re answer I’m Albanian and wife British
I entered Uk as a minor claimed asylum failed and overstayed got married and left to apply from back home voluntarily!
Do you wonder they’re going to back up before going to court

That’s a paragraph 320 (11) refusal. You need to appeal. You will win, judging from the brief facts of the case. Try to get a good lawyer and you should be fine.

The appeal process may take between 1-2years. I was refused based on paragraph 320 (11) in July 2017. I previously overstayer my visit visa and undertook 2 Law degrees from prestigious universities in London (paying home fees 😉). I lost my first appeal case in August 2018 because I didn’t use a lawyer. I got a lawyer and Won my second appeal case in December 2018. Submitted my passport last month. Now waiting to get the visa stamp.

Aparantly yes what does it mean
In light of the above I am satisfied that you have previously contrived in a significant way
to frustrate the intentions of the Immigration Rules by
(i) overstaying;
(iii) being an illegal entrant;
and there are other aggravating circumstances, such as absconding.
I therefore refuse your application under 320(11) of the Immigration Rules. This decision was authorised by an Entry Clearance Manager prior to the decision to refuse the application was made.

I’ve a lawyer we appealed it and we are waiting for the court date
Soliciotor said they don’t have ground so he said they could even decide not to go to court and reverse the decision
The 320 paragraph gets me on 2 points I entered the Uk illegally as I claimed asylum seeker
But I was a minor at that time at age of 15
And I overstayed after I got refused
Overstayed for 18 month

Any idea how long does it usually take for a court date after you’ve appealed it
Soliciotor said all this process takes 6-8 months

This is a 100% refusal case. It will come under deception as HO will confirm the employment of wife for which the documents have been submitted and the organization will tell them the fact. This could immediately put a ban on you for next 10 years. Never lie to HO as they are experts and you are not. Also absconding is the reason given in refusal and they are right as you deceived HO several times. People like you shouldn’t be given an entry clearance.
