ILR Visa from Tier 2 Dep

Hi All,

I will be applying for ILR Visa from Tier 2 Dependent. I have following queries. Please can anyone help me.

1. NARIC Certificate - I have done my graduation outside UK. Passed English Language Test and Life in UK. While filling up the online application form at the end in the list of other documents they are asking for NARIC. I am confused now, in spite of passing all test is it mandatory?.

2. Declaration signed by Husband to confirm consent for the Home Office to request verification checks - Is there any format? Please guide.

3. Evidence immigration status in the UK - What kind of evidence? Does this means Bills, Bank statements and proof from NHS?

4. What does this means - This is YES or NO question -What should be my answer?

'Is the account with a bank or utility company for which you have supplied information and supporting documentation held jointly by you and other people?' - I have joint account only with my husband.

Kindly guide me.

You should tick NO to the degree question if you are submitting a B1 English test. The question is ONLY relevant to meeting the English requirement. HO don't care what your qualifications are.
2. Declaration signed by Husband to confirm consent for the Home Office to request verification checks - Is there any format? Please guide.
You download it towards the end of the application.
3. Evidence immigration status in the UK - What kind of evidence? Does this means Bills, Bank statements and proof from NHS?
Your BRP card!
4. What does this means - This is YES or NO question -What should be my answer?

Hello All,

Please help me.

My Husband has ILR Visa.

- Currently I am on Tier 2 Dependent Visa completed 5 years.

- Before ILR my husband was student and then had Tier 2 work visa and I was his dependent. In total I have lived in UK for 10 years but I went to India for delivery and had a gap so I can only count these last 5 years)

- Along with baby I entered UK on Oct 6th 2014, until now I have travelled to India and stayed there for few months. In total in last 5 years I have lived outside UK for 328 Days.

Can I apply for ILR? Should I show any supporting documents for my stay outside UK?

There is no absence limit for dependent visas issued before 11 January 2018.

PBS and Appendix W dependant partners
You must not include any absence from the UK during periods of leave granted under the Rules in place before 11 January 2018 towards the 180 days allowable absences. For example, if a dependant partner’s qualifying period includes leave granted from 1 February 2015 to 31 January 2018, and an extension granted from 1 February 2018 to 31 January 2020, you must not count any absences before 1 February 2018.
Dependant children are not subject to limits on absences.

Don’t stress!
It’s very simple.. you do not need to account for any time period you were out of the UK if ur Ext or FLR was issued before 11 Jan 2018.

People under FLR routes (family/spouse routes) do not have absences limits at all.
PBS dependants on the other hand have abscess limit if visa issued after 11 Jan 2018

No. Date of application is the date you submit and pay online.
What should be last day of my application.
Anytime before your visa expires!

Hello,

We're reapplying for the ILR Visa that I was refused earlier this year and we came across this question that seems to be different to my earlier application right as we're about to make payment.

My husbands granted route into UK settlement is roughly as follows:
September 2010 - Tier 4 Student
Jan 3rd 2012 - Tier 1 PSW
November 2013 - Tier 2 Sponsored
January 2016 - TIer 2 Sponsored (renewed)
March 2019 - ILR
Is this considered PBS route?

My route so far
Entered UK - Feb 1st 2012 as Tier 1 PSW Dependent
Switched to Tier 2 dependent in October 2013
Expired in November 2013 as I had moved to India while pregnant
Granted Leave as Tier 2 Dependent in August 2014 along with newborn son
Entered the UK on October 6th 2014 with son
Renewed Tier 2 Dependent in November 2013 (Expiring this month)
Refused ILR Visa in March as I had not completed 5 years

Could you tell me what I need to answer for the question below?
Were you originally granted leave on the basis of an application made before 9 July 2012 as a partner on the family route? (Required)
Also is it the Set (O) route or the Set (M) route?

I paid for Visa application on Saturday. Appointment to submit passport and BRP is next week.
Now, I am uploading all supporting documents.

All the Documents which I am submitting are only from 2017 to Date. Is this Okay? (My entry date is Oct 6th 2014).

1. NHS appointment letters
2. Council Tax Bill
3. Bank Statements
4. Election Poll
5. Life in UK
6. IELTS
7. Marriage certificate
8. Indian Degree Certificate
9. Declaration Signed by me and husband
10. Passport and BRP
11. NINU
12. Tenancy agreement
13. HMRC and P60

Anything else I need to add to the above list. Kindly help.

You do NOT have to do both and if you submit a foreign degree, HO would expect to see UKVI NARIC English and comparable assessments. If you answered YES to the degree question, you should change it to NO if using the English test.

11. NINU Is this the national insurance card? NOT required.
12. Tenancy agreement You need evidence of cohabitation for 2 years, from at least 3 to 6 different sources in joint names or addressed individually to the same address. Unclear from what you have listed if this covers the requirement for the last 2 years.
13. HMRC and P60 Not required

Anything else I need to add to the above list. Kindly help.

2. NINU - Yes national Insurance card. I have removed.
3. HMRC and P60 - removed.

4. Proof of Cohabitation for 2 years -

c. GP Letter stating my registration and all appointments with them till date
d. Bank Statements
e. Election Poll
f. Council Tax Bill

I hope I have not missed anything.

Looks fine.. though only 3 will suffice.
Bank related, NHS and council tax over a period of 2 years.
