ILR for tier1 (5 year based )with non qualifying Family members

Post by QSDanik » Wed Oct 23, 2019 6:41 pm

Dear Seniors
I am back again to this platform. As I am goingto apply my ILR in August 2020 ( Tier 1 50K 5 year route), but my kids and my wife will be in that time but as they are coming to join me in Janurary 2020 as my tier 1 Dependents.

1- When I apply my ILR, I will apply thier application same time for my wife and kids , which catagories I need to apply for them, is is settlement visa for them? and which form set

2-As I will be on my Tier 1 visa when applying for my ILR and same time for my wife and kids, so What kind of my financial stability proof/ salary I need to show to support my family members. ( keep in mind as my wife might not able to have work to show 6 months salary slips , so it might be only me as main applicant to provide evidence of funds.

I will be very grateful to you for all guidance.
Regards
QSDanik

1. PBS dependent visa.

2. PBS dependent visas and maintenance of £630 per dependent for 90 days and cohabitation evidence.

There is no need to switch their visas.

Hello CROO1
Thankyou for your quick response.
Just can you please help me further calrification for my better understanding.

1. PBS dependent visa.

So my dependets will have like extention of PBS dependent visa while I will be having ILR

Will my dependent need to complete 5 years as on dependent visa to get their ILR ( as you said no need to switch visa)
so for my my kids and for my wife five year will be continue from the period of 1st entry visa of dependent visa.

2. PBS dependent visas and maintenance of £630 per dependent for 90 days and cohabitation evidence.

So I only need to show 90 days maintenance funds, Not any requirement for sepcific salary as tier 1 enterprenure.

Thankyou again.
regards

Thankyou CR001 and Cullinan
Can you please guide me in below situtaion

As I will be eligible for applying my ILR from Feburary 2020 on bases of 5 year on tier 1 visa, but my dependents will be on PBS tier 1 visa expiring on 06-08-2020 ( as per my visa)

Option 1
Applying my ILR in Feb2020

1-If I get approved my ILR before August 2020, Can I apply my dependents PBS tier visa to keep them on Tier 1 denependent visa to compelete 5 year

2- If my ILR dont get any answers till August 2020,( like my ILR application is still pending )
Can I Still apply my dependents visa as Tier 1 dependents in August 2020 few days before my dependents visa get expire.

3- God forbidden in Case if my ILR get refused, I will reapply or get AR etc, but what option i have to apply for my Dependents in August 2020?

Option 2
If I apply my ILR on 05-08-2020 as mine and my dependents will be expiring, so I apply mine for ILR and same time Should I apply my dependents visa Tier 1 Dependents? is it correct?

Or Please advise what is best option for me.
I will be gratefull to you.
Thankyou

You still apply IN TIME ie before visa expiry for PBS dependants ext.
