You do not have 10 years of lawful residence, so you better apply for a new application and vary to SET(LR). There might be a chance that under 39E you could be granted ILR

10 Years ILR application refused

Post by jonathan1981 » Mon Jun 10, 2019 3:23 pm

Dear Members

My ILR application refused. I have a right to appeal in 14 days need your suggestion

Immigration History
You landed in UK on 15th January 2019 with EC valid until 31 October 2011.

You made 3 successful in time application to extend your stay with temporary leave to remain the latest of which granted you leave until 27 November 2017.

You made an in-time application on 20 November 2017 for Leave to Remain under the Family and private life route (which was refused on 6th September 2018. The decision was later reconsidered, and you varied your application.)

You made an in-time application on 25th August 2018 for Leave to Remain under the family and private life route which was refused on 08 November 2018.

You made an application On 19 November 2018 FLR LR and you varied application into SET LR on 19 December 2018.

It is considered that you have not maintained continuous and lawful leave since arriving in the UK and you do not meet the required 10 years, so you cannot therefore meet the requirement of Paragraph 276B (i) (a). Your application for ILR is therefore refused.

Your appeal must mention this recent tribunal judgment regarding the paragraph 39E : https://tribunalsdecisions.service.gov. ... 04404-2018

Post by jonathan1981 » Mon Nov 11, 2019 10:14 am

Hi All,
I have applied ILR through 10 years continues residence route and got rejected below is the time line(appeal allowed).

How long do I have to wait to get my biometrics card? also waiting for "Implementation of court decisions" letter

Visa applied : 19/12/2018
Refused : 16/06/2019
Hearing attend : 19/09/2019
Appeal allowed : 07/10/2019 (appeal allowed)

"Implementation of court decisions" letter : waiting
BRP : Waiting

How long its take to send "Implementation of court decisions" letter?
Will Home office send BRP without "Implementation of court decisions" letter?
Today : 11/11/2019 will home office appeal against the decision?

Can you please share your experience (I feel stressful)

Thank you
Jonathan.

It would be helpful for moderators if you could elaborate your immigration history and refusal

You do not qualify for ILR as you do not have 10 years of lawful residence however it seems HO decided to grant you leave probably under FLR(FP)

Thank you for your reply

What is the next option available to get ILR?

Can I send reconsideration letter?

OR Can I Log Judicial review?

Best regards
J

Regularise your leave first. Switch to a 5 year route or wait until your 10 years is complete

As you regularised your stay now, paragraph 39E should apply to you. So I believe you can apply now however there maybe complications: indefinite-leave-to-remain/ilr-10-years ... l#p2048416
