ILR for family members

Hi,

I came via Tier 2 then shifted to Tier 1 in Nov 09. I got My ILR via Tier 1 general category in 2014.

My wife and Son were there in UK initially till 2011 and left to India and stayed in India until 2014.

They then came back to UK with the new 5 year dependant rule. and I did one extention using FLR (M) by proving Financial requirement. Now they are eligible for ILR.

Their current BRP shows that SPOUCE/PARTNER LEAVE TO REMAIN and DEPENDANT LEAVE TO REMAIN

I created online application, It shows Set(o) for each applicant. I am now surprised as that did not ask information it has asked previously.

It initially asked my details and then applicant details(Basic Personal, address, Immigiratin history, Life in UK, English and NI numbers). This does not ask cohabitating evidence, Financial requirement, etc. Even the Address I gave only for the last 9 months. Documents also very less(Consent letters, Passport, BRP, English certificate)
Either the Process has gone very simple or I am missing something.

Can you please confirm this is correct.

Set O is the wrong form.

It is SET M they need if they got their 2014 spouse/child visa after you got ilr.

You have likely filled in the questions incorrectly to get the set O option.

SELECTED - You're the family member or partner of someone who has settled in the UK

2 How did they settle?
SELECTED - On a work visa

3 What type of work visa did they settle with?
SELECTED - A tier 1, tier 2 or tier 5 visa

WEBPAGE - Shows information as below
You can apply as the partner or child of a tier 1, 2 or 5 visa-holder who has settled in the UK
You may be eligible for settlement (‘indefinite leave to remain’) as the partner or child of a person who’s already settled using:
* any tier 1 visa except Tier 1 (Graduate Entrepreneur) or Tier 1 (Post-Study Work)
* a tier 2 visa
* a Tier 5 (International Agreement) visa

But they dont hold tier 1 dependent visas so how do you believe that is correct.

The first part of the post you made also states
Eligibility for partners
Your current visa must be as a dependant on your partner’s tier 1, 2 or 5 visa.

If you got your current visa as your partner’s dependant after they settled in the UK, you must apply as the partner of a settled person instead.
