form AN for naturalisation

Post by Subh35 » Sun Oct 20, 2019 1:24 pm

Hi Moderators,

My wife is planning to apply for citizenship. She received ILR last year through Tier1 Dependent 5yr route

She was an officer (company secretary) and shareholder in our limited company between July 2016 to Sept 2019. She was not employed and didn't receive any salary from the limited company.

She also had a full time job.

But unfortunately due to a payroll system issue she was setup on payroll on 1st Apr 2018. After talking to HMRC a P45 was issued in June 2018 with the end date of 1st Apr 2018 (i.e. Same start and end date)

But when we recently requested my wife's employment history from HMRC, it listed her employment with our limited company with a start date of 1st Apr 2018 and end date of 5th Apr 2019. We tried to contact Hmrc but they suggested they can't change it and company has to contact them. But the company is closed now and hence they are not entertaining the accountant /payroll either.

My understanding from other posts in this platform is that its best not provide unnecessary information but don't want to be rejected for deception . However wondering if providing the above information will can be construed as misleading HMRC.

Now I am in dilemma:
1) Should she mention this employment in the form?
2) If yes, then with an end date of 1st Apr 2018 which is on P45 or 5th Apr 2019 which is on Hmrc record?
3) Should I mention in additional notes that it was setup in error, give the details that it was rectified by raising a P45 with same end date but end date on Hmrc employment record is 5th Apr 2019.
4) Should I also mention that she was an officer in this company between Jul 2016 to Sept 2019.

Please advise as our straight forward case has become convoluted due to this.

Thanks for your help in advance.

The 10 year employment history question is to gauge whether the applicant breached any immigration visa terms n conditions and whether relevant tax was paid during the time.
Better to state the info that HMRC has on the applicant. But even if you state the actuality it should have no adverse impact.

Thanks Aman, Are they interested in the fact that she was an officer and shareholder in the limited company. should i add this in additional information section?

She didn't get any salary from the company and so no tax was due. Could that be an issue?

Are you British and is she applying on the basis of married to a British citizen?? If yes, you need your passport scanned and the marriage cert.
and post the :
Referee forms
You do NOT post anything to HO. Everything must be scanned and uploaded.
Is there any other document we need to upload or post?
Nothing is posted anymore. You must scan and upload everything.

Hi CR001,

Few additional questions around documents:
Is Passport enough for proof of living in UK? if not what should we provide?

Is Passport and BRP enough as proof of identity?

Do we need to provide all pages of the passport (showing travel stamps etc)?

Apologies if these are already covered on other pages. In that case please direct me to those pages.

Thanks and Regards,
Subh

Thanks Aman. Clarification on point 3. She has an old passport as well, If stamps are required then should we include that as well?

Stamps covering her residence period.. 5 years normally. 3 years in case of spouse of BC. But no harm in old passports either.
