Spouse visa renewal help!

Hi,

My wife received her visa on December 24 2017 and her BRP expires in Sept 2020 and I am quite confused when we need to apply for her extension, is it when her brp expires or do I count 2.5 year when it was released?

Also what are the documents that we need to submit? We are currently living with my family.

Any advice would be much appriciated.

What date did she enter the UK in her spouse visa?

She entered the UK in January 15 2018.

She received her visa in 24th of december 2017.

She should apply no sooner than within 28 days before reaching 30 months residence, counted from the date she entered the UK.

Financial evidence of meeting the requirement.

English A2 test.

Evidence of cohabitation in both names for 2 years.

Would she be fine too if apply just before existing visa expire as its more than 30 months?

Cohabitation Example

Hi

My wifes visa is expiring in 6 months and we are going to applying for her extention but we are having trouble with proof of cahabitation.

We live with my parents in a council house and we have no bills under our names or her name.

Could someone help me please as I am trying sort her documents as early as possible.

Here are the list that we can provide for the last 24 months.

Payslips (we work at the same place)
P45
P60
Letter from work both jobs
Bank statement
Letter from council
Letter from my parents
Tenancy Agreement
Letters from NHS (her name)
Invoices
Credit agreement with her name on it
Letter of our one year old son
Fligh tickets with our names in it
Sainbury home delivery reciepts
and other home delivery reciept with her or my name on it.
Driving license


Any advice would be greatly appriciated!

What I ment by that is our name as sub tenants on the tenancy agreement.

What I ment by that is our name as sub tenants on the tenancy agreement.
yes thats fine. You can also use car insurance documents, mobile bill, gp registration letter, nino letter etc.

My wife received her visa on december 24 2017 and spouse visa is valid for 2.5 years which means her visa is valid until May 2020 but her BRP is valid until SEPT 2020.

Should I stick with 2.5 years? or Validity of the BRP? When renewing?

I mean why is the validity of the BRP different from the visa? Also once my wife visa expires and under process can she still work?

I don’t know if my counting is wrong but can we apply on this coming april or is it too early? It will be her 2.5 years stay on May 17 2020, counting January as the first month.

Is the validity of the BRP the lastest day we can apply for spouse visa extension? I need to get alot of information because I told my employer that my wife is due for renewal soon and they wanted me to explain things because before they had probem with past employee whos visa extention was rejected but employee didnt notify them and kept working for them without a visa for few months, they only found out that they his visa has expired when HMPO contacted them.

Will the case of the past employee affect my wifes spouse visa extention because we only found out a week ago :/.

You must have been given 33 months of initial spouse visa until 24th September 2020 which is pretty normal. You can apply extension 28 days before completing 30 months from the date of entering UK or you if you wish then can apply very close to expiry 24th September 2020.

30 months from 17 January 2017 would be 17 July 2019, so you would be a bit late in applying in this case. Assuming you meant 17 January 2018, 30 months from that would be 17 July 2020 and 28 days before that would be 19 June 2020. Apply between this date and the expiration on the BRP and you should be fine.

£18,600pa. British children are NOT included in the level of financial requirement.
