You submitted a Zambrano application, not a singh application.

Please only post in topics that are relevant to your Zambrano application, which is completely different to the Surinder Singh Route applications. Different applications have different processes.

Hello. 😊

I was traveling over the summer period, I was away end of May to 1st week of June then went home to Cyprus (parents lived there) mid August so I applied when I got back. I already got all my tickets sorted before I even received the paper forms. I didn’t want to apply and then request my passport back, I wasn’t so sure how long the wait after requesting passport so I just waited until all my travels are done then applied. xx

Hey all,

I just received this email reply to my complaint to the HO:
Thank you for your recent email of the 28 October 2019 concerning your application for settlement made under the terms of the European Union Settlement Scheme (EUSS). I am sorry that you have felt cause to complain about the standard of service that has been availed to you during the application process. I would also take this opportunity to extend the Home Office’s deepest condolences to you and all of your immediate family members in relation to the recent bereavement of your step-father.

I can confirm that consideration of your paper based EUSS application which the Home Office received on the 21 August 2019 remains ongoing. Our records indicate that we have previously returned your biometric residence card back to you on the 10 October 2019

You have applied for settled status on the basis of a derivative route (Surinder Singh) and by nature such case types are a little bit more complex than is normally the case, hence they are currently taking a little longer to process and finalise.

I am pleased to inform that we formally commenced consideration of your settlement claim on the 21 October 2019 and that an appropriate decision will be made in the near future.

The Home Office have to make a number of enquiries before we can reach a decision on whether or not to grant settled status to an individual under the terms of the EUSS. The extent and length of time taken to complete these enquiries varies according to the circumstances of each particular application.

So far our internal character enquiries have not been completed in regards to your specific application and we are most sorry for the delay. Please rest assured that as soon as we are in a position to conclude your EUSS application you will be notified of our decision with immediate effect.

In the meantime I have today issued you with a relevant Certificate of Application (COA) letter with immediate effect. I have posted out this correspondence to your home address today via first class post.

Thank you for your continued patience & understanding.

Harry Fewtrell

So they have sent out the CoA, which is something. I'm grateful they've responded.

I'm utterly baffled by the "internal character inquiries have not been completed" - what does my 'character' have to do with my application? Is this part of the rule changes that happened in 2016? So they are going to re-assess whether I should have been granted my 5-year RP? All of this is crazy-making and my case is such a simple one - some of you have a much rougher time than I do, so I can't imagine how any of you hold out emotionally, mentally, or physically. This is wrecking me.

So.. today I received my COA (dated November 4, 2019) after sending them an email complaining (October 23, 2019) that I haven’t received any confirmation after applying. I received an email on Monday stating:

“Dear XXXX

Thank you for contacting the EU Settlement Resolution Centre.

We understand that you have not received any notifications about the progress of your application.

We apologise for any inconvenience caused by this and appreciate your patience and understanding at this time.

We have now escalated this issue.

Please wait to hear from the caseworker and follow their instructions when prompted.”

And today came home with a letter from home office, would be lovely if it’s the settled status but nvm, at least got the COA now. xx

I'd love to see a poll in this thread similar to the poll that was created in the thread for non-EEA partner applications that checks how long after sending in biometrics a decision was given for the Surinder Singh paper applications. I've looked and couldn't find an obvious way to create a poll as a mere member - so I'm guessing that such a thing needs moderator permissions - is that correct?

Obie, CR001, someone with moderator status - are you willing to make a poll for this thread? Or point me how I could create it?

Thanks!

I made an application for Pre-settled status for my wife. She currently holds an EEA residence card issued to her under the 2016 EEA Regulations.

Application received date: 30th October 2019
Biometrics: Not required
COA: Received on 8th November 2019 (Dated 4/11/19) with her passport
Decision: COA states it will be issued shortly

Will let the forum know when we get the decision.

Hi Khan Said,

Yes that's correct, once you are in the UK you need to call the Home Office and ask for a Surinder Singh Paper application form. You won't be able to apply from within Ireland, you will need to move to the UK, and then gather evidence of you living in the UK, a plane boarding pass will be enough proof for your date of entry, and other than that, rental agreements, bank statements, bills etc will be needed for proof of residency. You would be applying for Pre-Settled status which would give you a 5 year biometric residence card.
You will also need proof of the British Citizen, exercising treaty rights in Ireland; your residency proofs such as rental agreements, bank statements, bills etc, and proof of employment there in the period of residency, and also proof of integration in Ireland.

Hope this helps you,

Irfan

Hi all,

So I'm a non-EU family member (spouse) of a British citizen, we have lived together in Ireland from 2015 to 2017. I do not previously have an EEA Family permit, just the Article 10 Residence Card issued by Republic of Ireland. and I have now applied for Pre-Settled under the EU Surinder Singh route. My timeline is as follows:

Application form completed and returned: 19th August (Special Delivery)
Application form received by Home Office: 20th August
Biometrics letter received: 29th (Letter dated 27th August) including return of passports - other documents not yet returned.
Biometrics given: 29th August
Certificate of Application: 2nd September (Letter dated 31st August)
Pre-Settled Status: (Pending)

Have called every week for an update, but the call centre seem to have standard answers, with no real timeframe for a decision. Looks like they are being quite slow. How are everybody's applications' going ?
Hi A irfan

Thanks for posting your inquiry. I planning to apply for my family through Surinder singh route as well from here in Ireland. I have been looking at these posts on Immigrationboard and what I have got is that:
There is no online application and I have to call UKHO and ask for an application which they would post it to the home address after checking the eligibility of the applicant.
I shall be grateful if you could share process please. And also whether these applications are for 6 monthe or for 5 years RC once approved?

Regards
Hi Airfan

Thanks very much for the replay. I thought you applied for Ireland, my mistake as u lived in Ireland from 2015- 2017. Ok so applied from within UK, did you get a visa to get to uk or the 5 years Irish RC was enough to move to UK and live there since 2017?
Just for information though, EU citizens can make complaints to SOLVIT online stating the difficulties an EU citizen and their families facing. SOLVIT have a direct contact with each EU country's HO.

Wow you get your status pretty quickly after getting your COA. Congratulations

I think you're the first person I can see who has got their confirmation via a Surinder Singh paper application that I can see.

We're still waiting for ours.

Does anyone know if we can re-enter the country while a Surinder Singh non-EEA paper process is being processed?

We have had our passports return by the HO but all of our supporting documents that proved we lived in Germany for years – they have (including my wife's German residency card).

Can we re-enter the country without those supporting documents and assert our Surinder Singh treaty rights?

Or are stuck here until they have sorted it out?

:(
