PBS Dependent Switch

Post by ananthkumar » Sun Nov 17, 2019 4:00 am

Hi,
Me and my wife are working in the same company.
Current Status:
Wife - Tier 2 ICT long term - valid till sep 2020
Me - PBS dependent - valid till sep 2020

My company is planning to raise a Tier 2 ICT for me in march/april 2020.
Will the cooling off period of 12 months apply to me ?

Note: I was only in UK for a period of 1 month ie ( March 2019 ) in the PBS Dependent Visa, after that I returned back to home country and never went back.

Cooling off period does NOT apply to PBS Dependents applying for main PBS visa!!

Thanks for the reply. I'm getting a little confused here.
Are you trying to say that the cooling off period will be applicable for Tier 2 ICT not PBS Dependent?
And PBS Dependent can switch to Tier 2 ICT anytime from home country?
Is my understanding correct ?

Cooling off period ONLY applies to main Tier 2 visa holder applying out of the UK for another main Tier 2 visa.

It does NOT apply to those who were in the UK on a Tier 2 Dependent visa applying for main Tier 2 visa from home country.

There main requirement for ICT though is evidence that you have worked for the sponsor in your home country for 12 months, however this has nothing to do with any 'cooling off period'.

Why would you not apply for Tier 2 General, which leads to Indefinite Leave to Remain whereas ICT does not?

That is a pity as you cannot even extend this visa for 10 years to reach 10 years long residence. The cut off under certain circumstances is 9 years.

Hello.
One more question.
Can I apply for Tier 2 ICT while having a valid PBS dependent visa ?
If yes, then what will happen to my PBS dependent BRP card ?

Your PBS Dependent visa will be cancelled if you are granted a Tier 2 ICT visa. You cannot hold two different UK visas at the same time.
