Tier 4 visa (child)

Post by leanne_019 » Thu Nov 21, 2019 10:45 pm

Hi

Is it possible for a child to transfer from a tourist visa to a Tier 4 (child) visa to attend a specialist school?

I have been advised that the best way to get my child into the UK is on a Tier 4 (child) visa and I have found what may be an appropriate school for him. He has Aspergers and the move will be unsettling for him, hence the need for a specialist school. This school is listed as a Tier 4 sponsor school therefore satisfies that requirement. The issue is whether the school is the best fit for my son. We may not really know this until we get to the UK.

Thanks

I don't think one can switch from tourist visa to tier 4 visa. You need to go back to your home country and apply from there.

I'm not sure about child applications though.
My advice is based on personal research/experience, so pls check relevant UKVI sources.

No. See paragraph 386 of the Tier 4 Policy Guidance:

You can switch into the Tier 4 (Child) Student category if you have, or were last given, permission to stay as a Tier 4 (General) Student.

I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.

Hi

Thanks, I thought that was the case unfortunately. It is ridiculous that I am a British Citizen (by descent) and Ihave sole parental responsibility for my 11 year old son, I have a court order saying my son can live in the UK to protect me from having a kidnaping case under the Hague Convention if the dad wanted to cause trouble and to get the court order through the Queensland Legislation I had to put that the child MAY have contact with the dad and that the child MAY visit with the dad and those clauses could get the visa refused as apparently it could 'prove' that I dont have sole parental responsibility! So annoying as my son has a right to have contact with his father if he wants to, but the Home Office might see that as me not having sole parental responsibility. In realty the father has the role of a babysitter, occassionally. So annoyed

@ sah10406 - also see OPs other topic for ILE queries. OP is BC by descent.
