10 YEARS LONG RESIDENCY

Post by main85 » Sun Dec 01, 2019 3:10 am

Dear gurus,

I need help regarding my long residency 10 yers route application,

Brief History :
entered into the UK on 26.01.2010

My lawful 10 years will complete on 26.01.2020

Currently, my T1 Ent extension is pending along my wife and 5 years old son as a dependent.

my questions are followings.

1. Can I apply my ILR before 28 days from 26.01.2020 while my extension application is still pending?
2. Can I go on premium service without original passport which is already with the home office?
3. Should I vary my wife's application (FLR(M) or FLR(FP) at the same time when I will apply for my SET (LR) or I can apply for her after the decision on my application? (Her passport was expired in 2018 and still held with Home Office and also she dnt has an English language test. For a test booking, we need passport which we don't have right now with us?)

I will really appreciate an urgent response to it.

Kind Regards

1. Yes
2. Yes
3. FLR(M). Do you have no other form of identity for taking test? You can request passport for taking test. Or. Vary and ask for it to be put on hold.

Would you consider varying to ILR under T1 Ent if you’ve completed 5 years..?

Dear Aman90!

Really appreciate your prompt response.

I tried to book with trinity college so all they were asked identities for booking tests are not possible too.
as you said we can request a passport for test purposes so any idea how long it will take to receive the passport after requesting online?

can I vary my wife's application after the decision mine?

Kind Regards

As a backup, apply for a provision driving license
Any suggestions I make in the forum are out my personal experience and should not be taken as a legal/professional advise.

Was your current Tier 1 Ent application made in-time or after your previous LR had expired?

It seems you reapplied for Tier1 ENT extension after refusal and are still waiting?
If that is the case than you are unable to apply for Long residence as you don’t have lawful stay.

no, this is my 1st extension application made before the expiry of my initial T1 ENT visa.during this waiting time since I applied for my extension so my entrepreneur team member visa was refused and then he reapplied again fresh application.
we have done interview in October 2018 and after that still waiting for the decision.

Apart of English language you should be earning £18600 to meet the financial requirement for flrm otherwise flrfp might be granted even without financial & English language requirement if you will be able to obtain ILR.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

hi all gurus,

With the grace of Almighty Allah, my tier 1 extension application has been approved and we also received BRP's.

While I was planning to submit MY LONG RESIDENCY application on 30th December and was planning for my wife to vary her application to FLR(M).but now I am planning to still continue long residency as I have completed 10 years.

My question is that my wife also has been completed her 5 years as Tier 1 depended so can she apply alone on 5 years ILR route, please?
the urgent response will be highly appreciated.

Kind Regards

If you get ILR under long residence, your wife must switch to FLR(M) and her 5 year ILR clock resets. She cannot get ILR under PBS unless you get ILR under PBS :!:

Thank you, Zimba for the prompt reply.

I have cleared now about my wife's ILR query.

One thing I will again clear ..if I switch ILR on a long residency basis so she still needs switches her Tier 1 ent dependent visa to FLR(M) either her visa just issued today and valid until Dec 2021.
OR she can continue with Tier 1 Ent dependent visa until her expiry of visa?

Please reply.

Kind Regards
