Tier 2 general extension

Post by Ramboin » Mon Dec 02, 2019 8:44 pm

Hi,
I am on tier 2 restricted visa for 2 years which is going to expire 13/03/2020 short occupation
I have few questions which I believe I can get answers here only
1. When is the best time to apply for extension.
2. What will be the start date on new CoS
3. What documents are needed to attach with application
4. My current employment contract says 4 years which will be around March 2022. If I apply for 3 years extension, will it be valid? Or shall I ask my company to provide new agreement.
5. My company financial statements says it is in loss from last 3 years. Can it impact my application? In anyways

I would appreciate your help in this matter.

1. When is the best time to apply for extension.

Just before a few days/weeks before your current visa expires.

2. What will be the start date on new CoS

The day after your current visa expires.

3. What documents are needed to attach with application

Read tier 2 guidance or fill the application to see the checklist (but don't submit yet), but generally passport and BRP are key documents.

4. My current employment contract says 4 years which will be around March 2022. If I apply for 3 years extension, will it be valid? Or shall I ask my company to provide new agreement.

It all depends on the CoS and what employer mentions in the CoS. So get the CoS for 3 or more years (under work days section). You don't need to submit your contract.

5. My company financial statements says it is in loss from last 3 years. Can it impact my application? In anyways.

It shouldn't impact.
My advice is based on personal research/experience, so pls check relevant UKVI sources.

Thanks srsw for your help. One more thing want to ask.
1. My soc code 2133 is removed from the short occupation list this year. Would it be fine if I change my role again to any other relevant soc.
2. Do I need RLMT in both cases whether I change job role or be in same role

Thanks

Not sure about this so wait for others to respond. As long as your soc code remains same you may be able to apply for extension application.

2. Do I need RLMT in both cases whether I change job role or be in same role

Extension application doesn't need RLMT as long as it's the same employer and role, but if your soc code changes then it may be needed. See this point in guidance:

95. If you are continuing to work for the same sponsor, but in a different role, your sponsor
must carry out a resident labour market test unless you are exempt. This includes situations where you are moving from a shortage occupation role into a job which is not in shortage. There are some exceptions, for example graduate trainee
programmes – see paragraph 223 for details.
My advice is based on personal research/experience, so pls check relevant UKVI sources.

Hi,
As mentioned earlier im completing 23 months and 26 days on 13/03/2020 and want to apply for 3 years.
If i apply in January, i still have less 2-3 months completing 5 years..
1. Can i ask my employer to issue COS for 3.5 years instead of 3 years ?
2. Will it be valid in HO if i apply more than 3 years ?
Please assist. Thanks,

Your cos can be any length as long as the total time on tier 2 does not exceed 6 years.

Thanks for the replying.
Is there any threshold on numbers or cos in December month for extension? I am going to ask my employer to issue cos this month so I apply by January first week.
Thanks

Extension applications within UK (uCoS) doesn't have any threshold, but do check with your employer about your plans and whether they can allocate uCoS to you this month or not.
My advice is based on personal research/experience, so pls check relevant UKVI sources.
