10 year ILR from Tier 2 General (Family)

Greetings,
I am planning to apply for 10 year ILR this month, I am currently on Tier 2 general, which is valid till Oct, 2020. My wife and kids are on Tier 2 dependent visas, which has the same validity.

Question is if I can apply for my ILR for 10 year route individually and apply for my family later (before Oct,2020 or later this year)?

Thanks CR001 for your prompt response, my kids were born here and my wife will be completing her 10 years in 2020, I am just curious about if I am granted ILR, what would be my dependent's visa status?

UK born kids can be registered as British once you get ilr. They do not need ilr to do this either.

Your spouse can only apply within 28 days before her 10th anniversary of entering the UK. She can stay on her current visa if applying for ilr (you don't state when exactly she qualifies for ilr) but should not travel out of the UK.

Her 10 years will be in 2022 and her current dependent visa is till Oct, 2020, I didn't get the traveling bit, can she not travel before Oct, 2020?

She needs to switch to FLR M and meeting the English and financial requirement. She should switch visas before traveling as you will be getting ilr based on LR and not PBS route and the rules about PBS dependents staying on their visas changed more than 5 years ago.

Greetings,
Hope everyone is fine, I got ILR (10 years route) couple of months back and tried the online form for my wife's dependant visa SETFM . I am finding it difficult to understand the minimum income requirement for my case.

I was a permanant employee from 2017 till 08 Nov, 2019 and then started my own limited company and started working as a consultant on 02 Dec, 2019, my company is created in Nov, 2019 and first tax returns for the company will be in 2021.

- My wife in on Dependant PBS (valid till 10/2020)
- I've two kids, both born here (will be applying for their naturalisation/passport soon)
- My salary in my employement was well above minimum income requirement

I would be gratefully if someone could shed some light on how could I use my previous salaried income in my case

What form exactly are you applying on and applying for?

You really have complicated things. You should have stayed in your permanent employment until your spouse had her spouse visa as only 6 months payslips and bank statements would have bee required. As self employed, you require substantially more documents to prove income.

for example:
Get my kids national first and then apply for "settlement on basis of private life" for my wife or any other option?

She came to UK in 2012, 7.5 years ago as my PBS dependant, she remained my PBS dependant till I got ILR on 10 year route on 5th Sept, 2019, here current PBS dependant visa is till 0ct, 2020

Such a pity you didn't apply for ilr based on the PBS route as she would have qualified already for ilr.

She can switch to FLR m before her visa expires but should not travel out of the UK. As this was already advised under your other username when you asked.

If your children are not British by the time she applies, you have to meet the £24,800pa income requirement.

I am confused on self employment bit as Home office requires tax returns for my limited company but my company's first tax return would be in 2021 (as per HMRC)

Which is why I said you have really complicated things by leaving your permanent job before applying for her visa.

You should read Appendix 1.7 for the full details on the financial requirements.

Quick Solution:
Find a paye job asap even with an agency paying you at least £18600 p.a and apply under category B which will allow you to combine your all previous yearly income.
