Biometric fingerprint under EU Settlement is free from my knowledge my sister. So pls don't panic.

With EU SETTLEMENT SCHEME being free Biometric registration to is free

Also all applications and applicants who pass fee waiver test also will have biomatric registration free

Good morning Obie. I need some advice on unmarried non eu spouse applying for eu settlement scheme Zambrano adult british citizen spouse. I applied for DRF 1 and got refused twice - the last refusal( dated Nov 6 the same day I got my COA for the EU settlement scheme) was I have not proven I am a direct relative and although I have an LPA they have deemed this not a legal guardianship order. Before the second refusal I applied to the EU Settlement scheme Zambrano on October 1st and got my COA on Nov 6 (dated Nov 2nd) and I am just waiting for a decision now.

Happy Holidays to everyone in this group, hope you guys had a fantastic Chris with your loved ones.

I need some advice please!!!

I got my ILR under the EU Settlement Scheme in September, prior to that I was a Zambrano Carer to my 2 British children.

My Nigerian boyfriend and I would like to get married, however he’s illegal in the UK. Can we go ahead getting married here and would be be able to apply for pre-settled status based on my EU settlement status.

Is your boyfriend the father of the kids or their primary carer.
Only minor children for whom you are the primary carer, can qualify under Zambrano.

No he’s not the father of the children. However I have indefinite leave to remain now.

I am good and looking forward for 2020, especially 31st January 2020.

Good submitting an application under EEA REGULATIONS C34/09 (Ruiz Zambrano) which is you Right under the Derive agreement from wider EU law.

Home Office have within 6 months to conclude this application and will respect that.

Your passport, your evidence and card will be sentback to you when the application consideration is done.

For now wait for your biomatric registration letter. When you enrol your biomatric infomation at the post office, you would be sent your Long COA to confirm your valid application under the EEA.

This could be done within one to two months and the rest of the months for decision.

Best of luck as Home Office has lost too many cases on refusing people without a promulgated law (statute law)

You will succeed

Are there anyone out here that have been issued an EU settlement status that have completed 5 years derivative residence and don’t have a valid derivative residence card?

DR1 which are refused should be appealed. The decision in Patel has been overturned in relation to children. Therefore the flawed policy and immigration rules which says that parent with leave to remain will not qualify for settled status, must now be abolished.

Thanks Fam, you have asked a question that made me went on appealing my refusal under Zambrano.

When the settlement scheme came on for especially Zambrano holders, it was easy to succeed with the main caseworkers guidance until Ukvis introduce the toxic Zambrano guidance. Derivative guidance and rewrote the main caseworkers guidance again.

What i found was that, in the main caseworkers guidance not and Zambrano guidance, there is a clause saying ""AND THE LEAVE IS NOT EXPIRED OR BEEN REFUSED""".

My leave has been refused due to Patel and Shah case so to stay within the qualifications, I appealed.

Some of us had Zambrano early so before the 31st March 2019 HC1919 which amended the Appendix EU withdrawal agreement to allow Zambrano people, we were swiming to nowhere.

Now Why Home Office is delaying issuing settled status to people who had Zambrano and has expired is within the settlement scheme it is a discretionary.

I have done so many Settlement application for people with live Zambrano residence card and within 8 weeks all had settled status because their leave hasnt expired.

Though the settlement scheme says SETTLED STATUS be issued to people who have continuously live here with Zambrano for 5 years, Home Office sees that as Discretion and would delay.

All those with live Zambrano who havent finished their 5year are being given PRESETTLED STATUS very quickly but those with expired are put aside

Politics is playing here and discrimination against TCN.

Please no matter what, if you have settled status application in, try add EEA REGULATIONS application under Zambrano because that is your right and Settled status is UK's promise to protect you after we leave EU

I ran out of time before I realised appealing was a wise choice. I believe at this stage I have no other option but to put in a fresh application.

I will further consolidate Snooky’s advice for all settled status applicants to put in for a DR1 as time is running out. 31st December 2020 is just round the corner, it takes up to six months for DR1 decisions to be made. Knowing the HO very well they will delay as much as close to the six months as possible to lure people out of being able to have an appeal hearing by 31st December 2020.

This now the time to play all cards right and be proactive.

Your thoughts guys... I am ponder at all angles. The HO are the most unpredictable governmental office..
