Question about Spouse extension

When to apply for English A2

I appreciate if you can provide some help. My wife is going to apply for spouse visa extension. She initially came on 8th August 2017 and had English A1 certificate.

I understand she needs to pass English A2 exam, my question is: can she apply for the A2 exam now or she needs to wait and apply for the exam after her 2.5 year anniversary on 8th Feb?

Now. If she is able, then do the B1 English instead.

Thanks Vinny, quick follow up question please, if she passes B1 now, can that be used for ILR in 2.5 years or will it be expired by then and she needs to resit the exam?

I think the exam has 2yr validity only?

It can still be used for ILR even if it has expired.

Subject to: 2.2
(b) the applicant-
  • (i) has limited leave to enter or remain in the UK, and
  • (ii) that leave (or a grant of leave which preceded it provided any periods of leave since have been unbroken) was given on the basis that the applicant had an English language qualification at a minimum level of B1 on the Common European Framework of Reference for Languages.
  • (iii) at the date of application, the provider of that qualification continues to be approved by the Secretary of State.

Thank you, will this also apply for Naturalisation or she will need a new B1 exam then?

I know this is far off in the future, sorry for asking many questions, just trying to weigh up whether taking B1 now will save her from having to take it again or if she is better off doing A2 now since B1 will be more difficult for her.

Question about Spouse extension

Hi,

I am filling out the extension application FLR(M) for my wife. I am going to be her sponsor.

In regards to the financial section. I am employed full time by the same employer for the last 2 years prior to the date of application. I have a fixed annual base salary which meets the financial threshold plus performance related commission (On target earning) that differs every month.

I meet the financial threshold from my base salary alone, but the monthly payslip total gross amount figure for each month is different due to the OTE earnings.

There are four choice from question "What do they earn":

1.The same amount continuously, above the financial requirement amount.
2.The same amount continuously, below the financial requirement amount.
3.Not the same amount continuously, above the financial requirement amount.
4.Not the same amount continuously, below the financial requirement amount.

I chose the 3rd option and the online form is asking for 6 months payslips and letter from employer.

Have I answered this correctly?

On a different note, is their a guidance for the spouse application form?

If you have a consistent base salary that meets the financial requirement as well as variable commission-based pay on top of that, either of options 1 or 3 would work. Yes, 6 months payslips/bank statements and a letter from your employer would be correct since you have been with the same employer for more than 6 months. Unfortunately, not really, there are guidance documents for certain elements but not a complete guide specifically for the FLR(M) application (that I am aware of). The requirements are broadly noted in the general family visa web page below. Completing the online application form should guide you towards the required supporting documents and you can always ask questions here.
