Visa Curtailment Letter

Post by abmka834 » Fri Jan 17, 2020 1:24 pm

Hello Everyone

I'm an international student here in UK. I was initially granted visa till 26th October 2020 to finish a 3 year program but i changed my course to two year intensive and finished my course on 18th September 2019. My university reported me to UKVI on 12th November.

Since then I'm waiting for my curtailment notice. Will i receive a curtailment with 60 days or my visa is already curtailed and I'm not aware of it as I haven't received any correspondence yet.

Thank you.

Whether you have the curtailment letter or not does not matter. Your leave will be curtailed to the course end date + 4 months, i.e. 18 September 2020, which is tomorrow. Given the timing of your query, I think you are probably aware of that already. In short, if you are still in the UK you only have until tomorrow to leave or make a new application.

Thank you for your reply.

If i leave within 30 days, will that impact any of of my future Tier 4 applications as I read that in few websites but don’t know how credible they are as I couldn’t find anything from Gov Uk

Thank you..

Why 30 days? When your leave ends, it ends. You have until midnight on the day it ends to leave the country. If you stay longer, even a few days, it can be held against you.

Thank you for your response.

I bought my tickets for 20th as I couldn’t afford tomorrow’s ticket.

In the above mentioned scenario, do u learned think it will be an issue for my September 2020 tier 4 visa application?

Probably not, but you need to check first that your new Tier 4 sponsor will not have any issue with it before issuing the CAS.

The Tier 4 application form gives you a chance to list and explain any overstays.

Thank you everyone for your reply.

I’m leaving early morning on 20th.

My graduation ceremony is on February 15 th and I want to apply for visit visa.

Reading from other threads, to my understanding it says i need to give bank statements for last 6 months but as I was in UK, I won’t be able to show bank statements from my home country bank account. In this matter, will ukvi accept a 15 days bank statement showing around 5000 gbp which i will spent for my trip??

Furthermore, do i need to declare my 2 days overstay in my visit visa application?

Thank you.

No disrespect to the people posting in those threads, but I advise you use the Home Office's guide to supporting documents instead:

Yes, all applications ask about any previous overstays.

Thank you for the guidance link.

The guidance doesn’t mention about the duration of the statement.

In this case, do u think if I deposit the money tomorrow in my home country bank account and apply on February will be a safe move as I overstayed my visa by 1 day i.e 19-20.

Exactly. It was you who said you need 6 months' worth of bank statements and that they must be from an Indian bank account. As you can see, there are no such requirements.

Thanks everyone for their valuable replies.

As I overstayed my visa by 2 days, what’s my percentage to get the visit visa to attend my graduation as I left UK on my own expenses.

Any experience in this matter will really help me.

Thank you once again

You need to check what the immigration rules, part 9; Grounds for refusal, say about how an overstay can affect a new entry clearance application.

https://www.gov.uk/guidance/immigration ... or-refusal

Paragraph 7B says it is a mandatory refusal only
where the applicant has previous ly breached the UK’s immigration laws (and was 18 or over at the time of his most recent breach) by ... Overstaying... unless the applicant ... overstayed for 30 days or less, where the overstaying began on or after 6 April 2017 ... and ... left the UK voluntarily, not at the expense (directly or indirectly) of the Secretary of State;.

Paragraph 11 says it is a discretionary refusal only
where the applicant has previously contrived in a significant way to frustrate the intentions of the Rules by... overstaying ... and there are other aggravating circumstances, such as absconding, not meeting temporary admission/reporting restrictions or bail conditions, using an assumed identity or multiple identities, switching nationality, making frivolous applications or not complying with the re-documentation process.

Does this mean I will be refused straight away?

You mean you think you will fall foul of that mandatory refusal paragraph? I thought your overstay is only 2 days?

Percentage? Like "you have a 72% chance of getting the visa"?!

It is you who knows your situation and can evaluate whether you meet the requirements, not me.

Thank you bro for your reply.

I will take that 72% a very positive number.

Just from your personal experience, have u seen any overstayer to receive visa without stress?

Thank you for the positive energy.

I hope you are joking. I just made it up, to show you that your question doesn't make sense! There are only two percentage changes of getting a visa: 100% or 0%.

See my previous reply posted Wed Jan 22, 2020 9:16 am. It quotes the two specific ways that an overstay can trigger a refusal of a new entry clearance application. Neither of them seem to be relevant to you, so I am not clear why you still think your application risks being refused because of your overstay.

Hi Sah Bro,

I am submitting my visit visa upcoming Sunday.

I have checked the required document list and prepared every document.

Just have a query, do I need to get a letter from the university saying that I am due for my graduation which is happening on YYth?
