ICT tier 2 to ICT tier 2 dependant cooling off period

Hi

I have recently travelled in ICT tier 2 sponsored by my employer , COS is valid till Oct 29 2020. I have returned to home country and I am not sure when I may travel back again to work for UK assignment.

My husband has an assignment now who is working for a different employer for ICT tier 2 assignment.

In this situation does cooling off period apply to me to apply ICT tier 2 dependent
Or
If I plan to resign from my current organisation and apply the dependant visa does cooling period apply


Could you please help with clarification.

There is no cooling off period if changing to a tier 2 Dependent visa.

Should the dependant visa be submitted only by the employer of the spouse or can I process the visa application by self?

Yes. You don't state if you are both applying from outside the UK or not.

Unclear if you plan on continuing working for them or not.

Your ICT visa is cancelled when the dependent visa is issued. If you plan on continuing to work for them in the UK, you MUST update them with your new visa BRP card to prove your right to work.

Just adding I am currently in my home country and not in UK.my COS is valid until Oct 2020.
My spouse ICT tier 2 and dependent visa application will be intended to be submitted from outside UK.
Since our work locations are different I may possibly need to resign from my current location.

Your ICT will be cancelled when your dependent visa is issued.

Any contractual obligations you have with your employer abroad is not an immigration issue.
