Someone who has competed a PhD in the UK with a Tier 4 visa will be subject to the 8-year cap. See

Plus, they can only apply in the UK for further Tier 4 leave if their CAS confirms academic progression. Speak to your Tier 4 sponsor to check this or see the Tier 4 policy guidance.
