Other naturalisation

Post by Jasper-T » Thu Jan 23, 2020 11:38 am

Sorry if this has been asked and answered, I can't find a search button on the board.

I live in NI and will hopefully meet the "becoming an Irish citizen through marriage' around November this year i.e one full year immediately preceding the application and two out of the four years preceding that.

I'm British born and Australian naturalised. Does the fact that I have an existing naturalisation (Australian) affect my Irish naturalisation application?

Ireland allows dual nationality. It will not affect your application.

This would mean I would have three passport.

The section on ‘Revoking Citizenship’ on the board gave me cause for concern:

U.K. and Ireland allow multi citizenships. You will need to check about Australian citizenship rules to check if they allow multi citizenship as well.

Do you think this site is wrong then?

Revoking citizenship

The Minister for Justice and Equality can revoke your certificate of naturalisation if:

You have, by any other voluntary act other than marriage or registration of civil partnership, acquired citizenship of another country.

That statement to me seems to mean if you acquire citizenship of another country AFTER you become a naturalised Irish citizen. Not before.

Citizenship cannot be revoked before it has been granted. In any case, I can’t imagine a scenario where that would be a possibility, except perhaps in a wartime situation or another, hopefully remote, dystopian future.

Irish Naturalisation - Absence in year leading up to application

Post by Jasper-T » Mon Feb 17, 2020 11:13 am

I live in NI and will hopefully meet the "becoming an Irish citizen through marriage' around November this year i.e three out of the last five years: one full year immediately preceding the application and two out of the four years preceding that.

I'm getting mixed messages :-( In the year (365days) leading up to my application date, can I leave the island for up to 6 weeks (total) or must I stay here for the full 365days?

Can someone please help me with a definitive answer?

:-)

That is what the recent court case was all about.

The upshot is you can be out of the Country for 6 weeks in the year prior to your application date. The minister does have the authority to allow for periods longer than 6 weeks under special circumstances (working away) but best to keep it under 6 weeks if possible.

You can be out of the state for 6 weeks in a year as a general rule. This has always been the case. The court case in the lower court merely delayed processing of the applications for a few months, and was eventually quashed. No application was rejected because one was out of the state for less than 6 weeks.
