Section 3 Application Force Applicant To Breach Employment Permit Act

Applicant waiting 2-3 years to get Humanitarian Leave to Remain (Section 3 Application) decision without any reason and applicant:

Can't work
Can't renew Irish Driving License
Can't access to Social Welfare
Can't eligible for Child Benefit

this application force people to breach Employment permit act 2003-2006 to work illegal in the state for basis needs and at the end INIS may ask to prove how did you survive while your application was pending.

There Should be time limit to get decision for Section 3 application, people living with families and kids and very hard to survive at present circumstances (Housing Crises).

Its totally disaster. Isn't it unfair system ? please share your views.

True very unfair, the system is very slow.
People waiting years for an answer.
Section3 applicants not allowed to work
Whereas asylum seakers have access to the labor market.

What status do the minister gives to the person seeking humanitarian leave to remain?
Is there any letter or temporary residence card ?

what if somebody working illegal during that process will he get the permission or they will refuse him because illegal work?

Minister gives Stamp 4 permission with limitation if someone still alive in the state. A kind of temporary residency card.

That's my point, they can ask anything from you at any stage without any logic or accordance with law.

I was told by most solicitors that if you are working during that process, they can't penalise you for it as you have to put food on the table. If asked you can give them the job details. When I was in the process I provided my contract details, pay slips, P60s and bank statements etc.

But I think problem may arise if someone entered the country illegally, started the employment while not having any permission (e.g. provided fake documents to employer) or had cash job and didn't pay any tax.

I was also refused a driving license while I was in the process. I sent the refusal letter to INIS and requested a timely decision on the application as the delay was creating difficulties for me.

@kupuser : if I'm not wrong you moved from section 3 to stamp 1 work permit. I PM you but didn't heard back anything, would you please share your experience.. thanks

@finalversion_2k- I had submitted a section 3 application and as a decision of it INIS gave me a temporary stamp 1 permission for 6 months with a condition that I apply a work permit before the stamp expired. I did so and successfully applied a CSEP. Now I am on stamp 1 based on that permit.

I tried to reply to the private message but it got stuck in my outbox for some reason.

@kupuser : thanks for reply I just PM you again.. I believe I'm following your path. so when you were on Section 3 at that time were you holding any status/stamp?? OR you first request for temp Stamp 1 and then look for job.. your reply will really help brother..

No. When someone is on section 3 application they have lost all stamps and residency status. I was working in the company for almost 7 years (had permission when I got the job - before losing status) and luckily the company did not open my file while I was on section 3. I informed them when I got the stamp 1 permission and they helped me in applying the CSEP.
