Tier 2 contract work

Hi Team,

I'm based out of India,one of the home office approved consultancy/company sponsored me the RCoS and my tier2 visa approved yesterday.Im planning to travel to UK on Feb 14th 2020.
I heard few people in UK saying recruiters not prefering tier2 general holders for contract jobs it scares as my sponsored company doesn't provide me job

Can somebody help me on this topic of i come can i apply jobs will companies prefer me for contract or permanent jobs.
My current industry is IT and skill as Bigdata specialist.

Any leads on this greatly appreciated.Thanks in advance

Your visa requires you to work for the company that sponsored you. I am not clear how they sponsored you if you don't have a job.
You are likely to be denied entry even if you tell the immigration officer that your "sponsored company doesn't provide me job".

How did you get the job? Did you apply for one of did they contact you directly?

Did you pay a fee for your RCoS?

Is the terms of you sponsorship to find your own contract jobs and the sponsor takes a percentage of your monthly salary as a fee?

Then you have been scammed and lost any money you have paid. These people prey on the desparation of migrants wanting to come to the UK and will tell you all sorts of lies to convince you it is legal.

You are not permitted in anyway to do contract work you find yourself in the UK on tier 2 general, it is illegal and will be a breach of your visa conditions.

You won't even be able to find contract work based on tier 2, no one will employ you. If you do come, you will struggle in the UK as it is expensive and you won't be able to work. You will not qualify for PR either after 5 years based on this type of sponsorship you have where you have to find your own contract employment because it is not permitted.

A genuine sponsor does not charge for a rcos and neither do they take a percentage of your earnings as a fee. Genuine sponsors also don't randomly approach migrants abroad and simply offer them a rcos. There is a very specific process employers must follow to sponsor someone from abroad. You are only allowed to work as an employee for the sponsoring company on their payroll and get paid your salary by the sponsoring company.

As the saying goes, if it sounds to good to be true, then it usually is. You would have been better informed to make a decision before you paid out all this money had you asked for advice first.

I hope for your sake you have not given up a job in India already, if you have one.

The choice is yours whether you choose to travel but I personally would not recommend it. 100% zero chance of you being able to find contract work in the UK based on your visa. No employer or recruiter will take that risk and will simply turn you away.

This actualy works and i am here in the UK based on that visa. what i can say is its very dificult to get a job on that visa unless your industry has serious shortage or you have serious skill and expirience.

It is very difficult and potentialy employers/contractors do not want the hustles asociated with hiring someone with that kind of visa.

You wont get scammed if you pay home office direct for visa applications, dont pay employer any money, but some employers want you to pay the RCOS application fees, wich i paid myself. but as long as you have the certificate, go for it, that is my advise.

You are missing the point completely and if you are here on tier 2 through an agency or third party and you have to find your own contract jobs, you are in breach of your visa conditions.

You cannot contract on a tier 2 visa, end of, it is illegal.

Any employer that asks for a fee for the rcos and a percentage of you contract job (if you can get one) earnings is not a genuine sponsor.

Do not advise people incorrectly that all will be ok. Migrants that try this are exploited and will find they cannot get ilr due to breaching visa conditions.

And to add to CR001's comment, if you have found such a work and you are working, if HO discovers it your visa will be curtailed and you will be asked to leave. In addition, breach of immigration rules would mean you fall into automatic refusal for your future UK visa applications.

It is perfectly legal, and because you havent encountered the situation does not mean it does not exist.

1. The company hires you and gives you a contract and sponsors your visa.
2. You look for contract work with day rates on your own.
3. When you get that job/work, the visa sponsor takes over and handles all legal issues.
4. Visa sponsor sends you work for the client as though the contract was theirs in the first place and as though they were the ones who got it for you.
5. So now you will be working for your sponsor for a contract role that now belongs to sponsor and payment is made to sponsor who then deducts their share and gives you your balance.
6. Everybody is happy.

It is illegal and a breach of your visa conditions. Doesn't matter how you are trying to convince yourself it is legal, it most definitely is not.

We have had many members who realised the breaches when they got to applying for ilr and had to leave the UK with a black mark against their immigration history.

You should also be aware that the forum will not tolerate any advice to members which is to breach the rules or how to get around the strict rules or circumvent the strict tier 2 rules. You will find yourself banned from the forum if you persist in giving wholly dubious advice to members on illegal practices.

I have consulted my friends about the same and advised it is illegal.

I think i have learnt a lesson here from this post and i will apply properly next time, fortunately for me i have completed my contract and i think i am done here (UK). I am now ready to head back home (Africa) to face new challenges.
