Tier 1 entrepreneur Spouse Visa to ILR

Hello admins,

I am really in need of help as bit confused. My husband got his TIER 1 ENTREPRENEUR visa in June 2014 for 3 years and I got my 2 years entrepreneur spouse visa in feb 2015 and came in this country in June 2015. we applied for our extension of tier 1 entrepreneur visa in June 2017 and our visa application was approved in NOV 2018 to Nov 2020. As my husband is eligible to apply for his ILR in June 2019 on basis of his completion of 5 years on entrepreneur visa and he also qualify ILR on 10 years basis in FEB 2020. now my question is:
1) Am I eligible to apply for ILR with my husband's ILR application which is due in June 2019 ????
2) OR should i apply for my IlR after completing 5 years on tier 1 entrepreneur spouse visa in June 2020 ???
3) If my husband applies for ILR on 10 years route ,would i be eligible to apply for my ILR with him???
4) OR Do I need to apply for spouse visa once he gets his ILR on 10years route and apply for ILR after completing another five years on spouse visa of a BC?

Please advise what is the best and quickest route to get ILR as per immigration rules.

1. No you are not eligible.

2. Yes, you need 5 years on dependent visa.

3. No. Long residence ILR does not allow dependents.

4. Yes, you would have to switch to FLR M spouse visa and this will reset your clock to zero and a new 5 year period before you can apply for ILR. Best for him to apply based on tier 1.

As I mentioned above My husband's 5 Years on tier 1 ENTREPRENEUR are completing in June 2019 as he has already been granted tier 1 entrepreneur extension till NOV 2020 so if he applies for his ILR in Feb 2020 as tier 1 entrepreneur, as my my five years as tier 1 dependent visa will also complete in feb 2020 so my question is:
1) is he allowed to apply for IlR as tier 1 entrepreneur visa IN FEB 2020 instead of June 2019?
and if he do so then will I be eligible to apply for my IlR with him in Feb 2020 ( as my 5 years are also completing as spouse dependent on FEB 2020).

I would appreciate your answers.

He can apply for ILR at any point once he reaches 5 years and BEFORE his current visa expires. If he applies in June 2019 based on Tier 1 Ent 5 years residence, YOU can still apply for ILR on your own in February 2020. There is no rule that you must both apply at the same time.

i got your point. my last question is:
If my husband applies on his own in June 2019 for his IlR and once he got it then will my status not be changed? like in FEB 2020 will i apply as spouse of permanent resident spouse (if i do so, will my clock won't reset to 0 ) or will I still apply as tier 1 entrepreneur spouse ( by completing my 5 years as entrepreneur spouse)???

No. You are allowed to remain under PBS dependat route until eligible for ILR as your partner is granted ILR under PBS route

As the rules are now, it counts from visa start date.

Hello admins,

I need advice regarding my ILR application.
I was granted entrepreneur dependent visa on feb 2015 for 3 years and i came to UK on 16th June 2015. later we applied for our extension and Granted visa till NOV 2020. Basically my husband is planing to apply for his ILR on 5 year entrepeneur route in February 2020 and apply ILR for me and my two daughters after his ILR approval. In these circumstances i have few confusion and i request all to please help me.

1. AS I WAS GRANTED VISA IN FEB AND I CAME IN UK IN JUNE DOES THESE DAYS COMES UNDER 180 DAYS ABSENCE IN 12 MONTHS? AND AM I STILL ELIGIBLE FOR ILR AS 5 YEAR ENTREPRENEUR DEPENDENT VISA.
2. if yes then do i need to give english proficiency test like Ielts or can i get my degrees equivalency done by UK Naric? for ILR.
3. if my husband apply or his ILR first and after his approval can he apply my and my daughters ILR without any restrictions.
