No she cannot. ILR based on long residence does NOT permit dependants to apply with you. She also does not meet the requirement for long residence ILR.As I am planning to apply for my ILR in January (Long Residency) and she was with me since 2012, can she also apply for ILR?
She has to switch to FLR(M) spouse visa, English B1 and financial requirement must be met, once you have been granted ILR. Her 5 year ILR clock will be reset to zero.if yes, does she need to that after my application has been approved? If no, what happens to her dependent visa, which is still valid till December 2020.
If your wife's date of entry is correct in your post, she will qualify for ILR under 10 years long residence in 2022.Ashil wrote: ↑Sat Dec 07, 2019 11:15 amMany thanks for your prompt reply.
Could you please answer these two follow up questions:
as she has been in the UK from 2012, does this mean after getting her spouse visa from FLR(M) route, she could still apply for ILR in 2020 via Long Residency Route?
Also, as my tier 2 visa is valid for another year, so as her dependant visa, does she need to apply for FLR(M) once I got my ILR, or she can wait towards end of her current tier 2 dependant visa? If yes, does this affect any travel outside the UK, given that my tier 2 visa is no longer valid?
Many thanks in advance,
Dave
Hello again!
It is no as the options are if entry clearance as a Fiance visa or current for m visa holder.
