Going for ILR - gross salary is less than the salary stated on CoS

Post by thandunaresh » Wed Feb 05, 2020 4:00 pm

Hello all,

I am planning to apply for the ILR in the next few days.

Last year, I have received a lesser salary around £40800 where as on my CoS it was stated as £42000.

At the moment, I am getting £50000 and I have payslips and a letter from the employer supporting the same.

The reason behind lesser salary is my company was paying that money towards the parking so that I can save some money on tax.

Is that going to cause any issues?

Thanks

Deductions are allowed. Your base salary is what only matters

Thanks for replying.

But in my P60 - the deductions are not being shown and P60 is showing a base salary (taxable + non-taxable) which is different from the salary that was stated on CoS.

Would that be still okay?

Actually, would the home office cross-check the P60 with the CoS?

Thanks

Do we need to provide the dependent details when applying for ILR

Post by thandunaresh » Wed Feb 05, 2020 9:31 pm

Hello all,

I am on a tier-2 general visa and my wife and kids are on a different visa and they are not on my tier-2 dependent visa.

We don't have any intention of applying ILR for my family along with my ILR application as they are not on my dependent visa.

Do I need to provide my family details under the dependents section even though when they are not dependent on my visa?

Thanks,

P60s are not needed for ILR. What matters is how much you are being paid now

Thanks again for the reply.

So if I understand correctly, there wouldn't be an issue as I will be paying more than the ILR threshold.

But in-general, is salary sacrifice allowed for someone who is on a tier-2 visa?

Thanks,
Naresh

I do not see anything wrong with it however if you are not being paid an appropriate salary, you don't get points for a visa extension/ILR
