Absences that are partly for annual leave, partly for business

Post by mahs » Tue Jan 28, 2020 10:16 pm

Hi All,

I have a Tier 2 General visa, working in a university and I want to apply for ILR.
In the past 5 years, there are periods that I have exited the UK for example for one month; spent half of that on research/conferences/other university businesses, and the other half as annual leave.
How can the university show this in the employer letter? Does something like the following work?

...
[He] was absent from the United Kingdom, in India, for the following periods;
1 01/01/2009 30/01/2009 29 Annual Leave for 14 days, the rest for research
2 01/06/2009 15/06/2009 14 Business Trip to France for 7 days, the rest for annual leave

Many thanks

You are overthinking this. It does not matter what you did outside the UK in each period. Each period of absence simply should be approved by your employer. There is no need for them to explain what you did

Thanks.
I think I perhaps omitted some important information- apologies.
I am doing this because the dates I was out of the UK is far more than the 30 days annual leave that I am entitled to. That is why I want to explain that parts of my absences have been for research/conferences/etc, and not for annual leave.

Here is the complete view of my absences:
24/07/2015 to 24/08/2015 30 Annual leave/ Research visit from 24/07/2015 to 02/08/2015
11/03/2016 to 14/04/2016 34 Annual leave/ Research visit for 12 days
09/10/2016 to 13/10/2016 4 Conference
09/11/2016 to 28/11/2016 18 Project meetings (8 days)/ Annual leave
23/12/2016 to 11/01/2017 18 Annual leave/ Research visit for 7 days
23/05/2017 to 30/05/2017 6 Workshop
02/09/2017 to 26/09/2017 23 Annual leave/ Research visit for 8 days
17/03/2018 to 11/04/2018 23 Annual leave/ Research visit for 8 days
30/08/2018 to 18/09/2018 18 Annual leave/ Research visit for 7 days
24/07/2019 to 22/08/2019 28 Research visit

So the question is the same: How can the university show this in the employer letter? Does something like the above work?

Thanks in advance.

It does not matter that your absences are more than 30 days. The advice remains the same. It is irrelevant what you did when you were outside the UK. The rules do not require you to provide a breakdown of what you did during your absences

ILR application- Tier 2- 28 days

Post by mahs » Sun Feb 09, 2020 5:31 pm

Hi All,

I'm on a Tier 2 visa which was valid from 6/3/2015. I entered the UK on 15/4/2015.
When is the earliest I can apply for ILR? 28 days before 6/3/2020 or 28 days before 15/4/2020?

Many thanks

No sooner than within 28 days before the 5th anniversary of your initial visa ISSUE date!

Thanks.
Where can I find this visa visa ISSUE date? (I don't have any letters that they might have sent 5 years ago).
Is this the same as the "valid from" date? I have used the "valid from" date for calculating when I will be eligible (28 days before 6/3/2020 is 7/2/2020). I actually made the payment today! But I am now worried that I might have messed up.
Any help is much appreciated.

Entry clearance being issued / Visa valid from date

Post by mahs » Sun Feb 09, 2020 10:27 pm

Hi All,

I'm on a Tier 2 visa and want to apply for ILR.
I have seen on Home Office's guideline document and in this forum that one can apply within 28 days before the 5th anniversary of the initial visa issue date.

My question is where can I find this visa ISSUE date? I don't have any letters that they might have sent 5 years ago.
Is this the same as the "valid from" date on the initial visa?

I have used the "valid from" date for calculating when I will be eligible (initial visa was valid from 6/3/2015- so 28 days before 6/3/2020 will be 7/2/2020).
I actually made the payment today! But I am now panicking and worried that I might have messed up.
Any help is much appreciated.
(To mods: apologies for creating a new topic- I thought other people might find this useful.)

Valid from date is correct.
