Hello Guys,

I initially made an EEA application which was unsuccessful. My lawyer advised that I should switch to EEA settlement scheme because it’s independent of past immigration history.

Anyone in the same boat as me? If you made an application, what was the outcome?

It’s been almost 6 or 7 years since I have been going back and forth.

The only reason I might apply for the settlement scheme if I get a less optimistic reply to this post is just so HO could see my face, and be like this dude again?!!

Let’s just give him what he wants, so he stops bothering us with applications. lol. I still have my sense of humour but have lost hope.

This is the best solution
I've been in the same boat as you since 2014
Going back and forth, in fact they've denied my application countless times but last December I got a letter from them asking me to send my sons birth certificates and proof that me, my son and my eu wife is living together which I did and they wrote back asking me to apply through this Scheme which I've done since January.
So this is the best option for you trust me you'll soon smile

Hi an update on my application - I've got the pre-settled status today 22/2/2020 via email, and they will send me the BRC within 7 days. I got in touch with my MP on 17/2/2020, that might have helped.

they told me the reason it takes so long is because I used my BRP, obviously Passport and BRC is using the different system and BRP is under passport system, but since it is very similar as BRC, BRP application in the first place will go to BRC system, and it takes time to transfer from BRC to Passport system, so as a safe card if you have both a passport and BRP card, use passport to apply if you can, it will save your time I believe based on my experience. thank you , hope you all have a good day.

Asked for eu partner id. Spoke to case worker and she said its better to upload another residency proof. As the bank statement had only one transaction (we only use that for bills and rent)
So along with partner id uploaded another bank statement.

Ah I see. Did you originally quote and apply through your partners settled status reference number though?

This forum has helped us a lot in guidance and support through my husband BRC application via the route of EU settlement. I wouldn't miss the opportunity to share it with everyone in here.

My husband received his BRC(pre-settlement status) through the route of eu settlement today. It says on remarks "work permitted and leave to remain. Unsure what the "leave to remain" means in greater details.
I want to know if there are restrictions to travel outside of UK. We are planning to go to either Brussels or Paris for a short trip for our honeymoon since we never really celebrate it due to long distance relation.
I also want to know if he requires to apply for the old route EEA2 and whether this would facilitate him to travel in Europe countries.

For those waiting, I wish everyone will get a good outcome of their applications.

Here is my husband timeline:Married to me (eu national with ILR).

-Application sent December 2019- this was linked to my reference of settlement status
-Appointment for fingers printings etc on 8th January 2020 (late booking as it was the only date free of charge online hence selected)
-COA received 2 weeks after appointment
-BRC received 23rd Feb 2020.

What I read and understood so far about the "leave to remain" means a temporary permission to stay in the UK. That would change into ILR upon accumulating 5 years in the UK and fulfilling other requirements.
Well I think card issued under EU settlement scheme doesn't allow to travel to EU as it is not like the RC of EEA family member on which it is printed "Residence card of the family member of a union citizen". I am not sure whether one can apply for EEA2 RC after obtaining an EU settlement based.

I’m sorry, I don’t fully understand. Are you saying that non-eu citizens with settled /pre settled status are not able to travel outside or re enter the U.K. without their EU spouses that they applied for their settlement through?

This forum has helped us a lot in guidance and support through my husband BRC application via the route of EU settlement. I wouldn't miss the opportunity to share it with everyone in here.

My husband received his BRC(pre-settlement status) through the route of eu settlement today. It says on remarks "work permitted and leave to remain. Unsure what the "leave to remain" means in greater details.
I want to know if there are restrictions to travel outside of UK. We are planning to go to either Brussels or Paris for a short trip for our honeymoon since we never really celebrate it due to long distance relation.
I also want to know if he requires to apply for the old route EEA2 and whether this would facilitate him to travel in Europe countries.

Here is my husband timeline:Married to me (eu national with ILR).

-Application sent December 2019- this was linked to my reference of settlement status
-Appointment for fingers printings etc on 8th January 2020 (late booking as it was the only date free of charge online hence selected)
-COA received 2 weeks after appointment
-BRC received 23rd Feb 2020.

What I read and understood so far about the "leave to remain" means a temporary permission to stay in the UK. That would change into ILR upon accumulating 5 years in the UK and fulfilling other requirements.
Well I think card issued under EU settlement scheme doesn't allow to travel to EU as it is not like the RC of EEA family member on which it is printed "Residence card of the family member of a union citizen". I am not sure whether one can apply for EEA2 RC after obtaining an EU settlement based.

I’m sorry, I don’t fully understand. Are you saying that non-eu citizens with settled /pre settled status are not able to travel outside or re enter the U.K. without their EU spouses that they applied for their settlement through?
I meant to travel to European countries without visa or not
