Remote working with Gen-tier 2 and absence clarification for ILR

Post by balamv » Fri Jan 24, 2020 9:11 pm

Hello !

Apologies if this is already answered elsewhere, but I couldn't find any answers related to my queries.

I came to UK on Feb-2018 through General Tier 2 visa (Employer-1). Within this 2 year I had been to my home country 2 times for vacation (60 days outside UK). I changed my employer who sponsored me Gen Tier 2 visa. I applied for visa on Nov-2019 and its valid until Nov 2021. My current employer is flexible with remote working,I am planning to visit my home country frequently and planning to spend 100-120 days (2-3 trips) in a year. So it will be around 300-350 days in another 3 years. It would be helpful if you could answer my below queries,

1) During my stay outside UK, I would be still getting salary in UK bank account. Also I would be paying tax,NI,Rent and all other bills. Is this legal to do remote work from outside UK ?

2) I need to make sure time spent outside the UK should be within 180 days in any 12 month period. Is my understanding correct ?

2) Will I be questioned about long absence/purpose of frequent visit in UK border at airport ? If so , do I need to get any letter from my employer about remote working ?.

3) As I am eligible for ILR after completing 5 years in UK, will this absence affect ?

4) While applying for ILR, Do I need to get letter for vacation/ Remote working from all the employers to prove my absence ?

Many Thanks in an advance !

Hi ,Can anyone please reply on my queries as am planning my trip next month. In short, with Gen-Tier 2 visa I am planning to spend 4-5 months in total in a year (not continuous), so that I can make sure 180 days presence in UK in any given 12 months. My current BRP is valid till end of 2021. In a nut shell, I am worrying more about UK immigration check (entry to UK after each frequent travel) and visa extension than ILR.

1) During my stay outside UK, I would be still getting salary in UK bank account. Also I would be paying tax,NI,Rent and all other bills. Is this legal to do remote work from outside UK ?

2) Will I be questioned about long absence/purpose of frequent visit in UK border at airport ? If so, do I need to get any letter from my employer about remote working ?.Will I be able to enter UK with current BRP?

3) While applying for ILR, Do I need to get letter for vacation/ Remote working from all the employers to prove my absence ?

Many thanks in an advance!

I wish someone could answer to this question. It is so crucial for me as well. I visited my parents for 7 weeks. Worked 6 weeks remotel from abroad and had 1 week of paid annual leave. All approved by my employer. Same scenario really. The answer for this post will enlighten me as well.

Thank you everyone for keeping such a valuable forum alive. I am amazed. I wish I could also help others here.

My employer told me that due to tax regulations, I need to be physically in the UK and I cannot work remotely under Tier 2 visa.

Did you have the same experience?
