PBS dependants extension after setelling of main applicant

Post by StayAtHome » Thu Apr 02, 2020 9:58 pm

Dear all

thank you for your help
My Question is about : PBS dependants extension after setelling of main applicant.
the main applicant had Decemeber 2016.
dependant started qualifing period in 04/2016.
dependant visa was renewed for 3 years from 05.2017 ( according to 319D) till 05.2020.
Dependant will qualify for ILR in 04/2021.( please correct me if wrong)

Can the dependant apply for another extension of the Tier 2 visa for another year from 05.2020 till 05.2021 untill qualifying for ILR?

the confusing point is that 319D wording has changed to ay PBS dependants with settled partners will only get 3 years. but SWS dependants guidance ( point 53) says we can aply for further leave till the qualifying period for settlement.

Thank you for your help

319D is the Immigration rules, and that is all that is important. The guidance is just that, a guidance document.

She will get a 3 year extension.

thank you for your reply
The dependants were already granted 3 years in 2017 after settling of the main applicant.
If the dependant apply now for an extension again till qualified for would that be granted?

It is a 3 year extension as clearly stated in the immigration rules.

I am trying to explain that the dependants were already granted 3 years last time in 2017 after settling of the main applicant as well.
They won't qualify for ILR for another year.
So can they apply now for an extension after the initial grant of 3 years?

Yes. Unclear why you believe they can't. There is no limit on the number of 3 year extensions they can apply for.

Thank you
Another question please:
I am filling my dependants' applications for extensions. My COS was issued a few years ago while my job was not listed as a shortage occupation. My job is now in the shortage occupation list.
Are we paying shortage occupation fees or normal fees as the COS was issued when the job was not included in the shortage occupation?

I am really grateful for all your great help.
