Tier 1 Dependent Visa

Dear Members .

i am applying for my Spouse Tier 1 Dependent Visa. i got my T1E ILR in September 19. we have 3 kids they already got British passports.

my spouse is going to apply for 10 year route ILR in September 2020. her current visa(T1 E dependent) expiry is 17 April 2020

my question is
1. which is the best and cost effective route to apply , t1e dependent or parent of british child or any other if you suggest please.

2. i think i am in a bit of trouble as guidance says that applicant should have maintenance Funds in their account for at least 90 days while she doesn't have any funds in her accounts . theses maintenance funds are in my account 3300 from last 6 year . i never touched them. would you please guide if its ok or its going to be a problem.
guidance needed please

1. Parent of British child is for those who are NOT in a relationship with the other parent, so not relevant to her. She can extend her Tier 1 dependent visa if you got ILR based on PBS route. If you got ILR based on 10 years long residence, she has no option but to switch to FLR(M) meeting the English and financial requirement. If you don't meet these requirements, she will likely be granted the 10 year FLR(FP) Partner route. You were already advised about extending PBS dependent visa in September last year when you asked. Nothing has changed. indefinite-leave-to-remain/t1-dependent ... l#p1831229

2. The maintenance funds can be in EITHER of your accounts. It does NOT have to be only in her account.

we are married , and have three children. one of them born recently on 2nd December 19. do we still need to provide cohabitation. if still answer is yes. (would marriage certificate not be enough?)

please i you could advise,what sort of cohabitation proof they need. as we do not have any join bills. or bank statements.

if still answer is yes. (would marriage certificate not be enough?)
No.
please i you could advise,what sort of cohabitation proof they need. as we do not have any join bills. or bank statements.
Anything in your names, joint or addressed individually, ie HMRC letters, tenancy agreement, utility bills, council tax, TV licence etc etc

ILR qualification date is 24-08-2020, but she can apply 28 days before that date.

What date did she enter the UK?? Long residence ilr starts counting from date of entry to the UK not the visa issue date.

You need 2 years evidence in both names spread evenly across the period from at least 3 different sources.

You only need two years worth but you should have different sources. So bank statements, driving licence, lease agreement, council tax bill, etc. would all help. You just need to submit 2-3 pieces of evidence for every three months (as an example) during the last two year period - you do not need to submit 24 sets of each.

Admin could you please check the information again because as you said that if any PBS migrant applies ILr on the basis of long residence dependent can not extend their visa as PBS dependent am sorry but this is incorrect. I got my ILR on the basis of long residence when I was in Tier 1 entrepreneur and my dependent got their Visa extended 5 months after my ILR for another 3 years without any issues . Which clearly means that dependents can carry on with their pBS dependent visa and no need to switch it till they qualify for ILR after completing their own qualification period.

2. The immigration rules are clear about this and changed in April 2014. It was likely an error in your spouse case if you got ilr on SET LR.

Spouse visa Expiring on 17 april 2020

hi.
Spouse Tier 1 Dependant visa is expiring on 17 aprill . i sent email to CIH@homeoffice.gov.uk about 10 days ago but i have not received any reply.

would seniors please advise what should i do in this scenario ?

her ILR long route is due in September 2020

You need to apply online BEFORE the visa expires.

Has this not been done yet?? What exactly are you expecting HO to say when applications can still be submitted online?

I thought they would give extension till may and then i can drag it till ilr . But after reading your reply now i think i was wrong.

As i thought applicant would get extension till may and also because sopra stera offices are closed

The extension to applies only for those who are in the UK with expired or expiring visas who are unable to travel back to home countries. This obviously doesn't apply to you.

You MUST apply online before visa expiry which is the date of application. If you do not apply before visa expiry date, it will be an out of time application and a possible break in 10 years legal stay for ilr, so very very risky.

Date of biometric appointment is irrelevant to making an in time application and is ONLY for identity check and biometrics.

Once the centres reopen, you simply book the appointment as usual.

There is likely no way you can "drag" anything out till qualifying for ilr LR in 6 months time.

i will do that
the only problem is that banks are not entertaining request for cash in and cash out. they are not giving bank statements inside bank. so i wouldn't be able to get bank statement for three months on time.
Main requirement is

T1 dep pbs exten


Passport
maintenance funds( thats in my account not in my spouse account)

and cohabitation proof
is there anything else that i need to keep in mind please
