Hereditary Citizenship

Post by Hilary » Sun Apr 19, 2020 9:03 am

Hi again.
Ok, I now hold ILR (2020)
My husband is British from birth
Our daughters are born here, & are dual citizens-Filipino.
The children were born whilst I was on a spouse visa & extended leave visa

I understand that for these daughters children, those children will need to be born here in the uk for the citizenship to pass down. Meaning, if those children are born in the Philippines they’ll have no right to citizenship here in the uk!?

Anyone?
Best regards

Your children are British otherwise than by descent.

If they have children outside the UK, their children will be British by descent.

Where is "here"? Is it the UK, the Philippines or somewhere else?

If your daughters were in the UK, then CR001's advice above is correct. Your British born daughters will be British citizens otherwise than by descent and children born to them (your grandchildren) anywhere in the world will be British citizens by descent. However, British citizenship can descent automatically only one generation outside the UK.

If your daughters were born abroad (outside the UK), your daughters are British citizens by descent (because their father is a British citizen otherwise than by descent, because he was born in the UK), but their children (your grandchildren) will not be British citizens automatically unless those grandchildren are born in the UK.

Hi again

Just wondering

So one generation can be born outside of the uk & be British by descent.
What if one generation is born here/Uk
The next outside the uk
The next in the uk
Can you go again with born outside?

Just wondering, is one a one off
Or you can alternate

Assume that's all possible if everyone remembers the principle - importantly if a person British by descent has a child in the UK that child will be British otherwise than by descent.
