Re: Self employment visa extension after 2.5 years

Post by Adnan20161993 » Sat May 09, 2020 12:43 pm

Thank you.

So I was required to do a TB test when my wife first applied for my visa. When I came to the U.K. in January 2018 I had a valid TB test which has now of course expired. I went back to my home country this year from February to March. I should be applying hopefully around August time. Will I be needing to do a TB test again for my visa extension?

It is not required for extension

Hello. I recently came on here asking for help with my visa extension. I was helped and informed I could apply through the Category B route. My wife is on maternity leave and is receiving maternity pay. I am working through an agency on a temp contract. We will apply for my extension in August. From August 2019 until this year August we will have earned a combined income of £18,600. In the 6 months prior to when we apply in August, so from February-July payslips we will have earned a combined total just over £9,300 which is half of the £18,600. My question is, I am currently self employed but can not use self employment as my income for my visa extension as I have not been doing this for a full year, so I am using the agency employment. can I leave my agency employed job to return to my self employment? As we will have earned £9,300 In the 6 months prior to the application. My wife will be on a maternity wage so if I am “unemployed” to home office at the time of the application would this be a problem?

Yes you can but UKVI caseworker expects to see the person with same employer on their enquiry.

So if I leave now as I am going to be showing their wage slips this would be a problem? It’s just that I am finding it hard juggling with my self employment which I can’t show and then working for my employer for my visa extension. But I guess if it would be a problem I will have to stick with it for a few months

My biometrics card says it is valid until 09-10-2020. When is the earliest I can apply for my spouse visa extension?

Any time between within 28 days of reaching 30 months residence in the UK from date of entry OR before your visa expires.

Your apprehension is valid but for handling the capricious visa matters you have to sacrifice something while being resilient.

Sorry please forgive me;
I received my visa on 9-01-2018
Entered the U.K. 29-01-2018

So the 30th month would July 09 2020 or july 29 2020?

And then it would be 28 days before one of those 2 dates? Meaning if it was July 09 then I can apply 28 days before this? Or if it is 29 July then I can apply 28 days before this date?

Also applying this early would it affect me when I want to apply for my ilr?

Repeating same query won't speed up the answer as most of the member are volunteers with other jobs & activities. You may apply on/after 1st July.
https://www.timeanddate.com/date/datead ... ad=28&rec=

Same 28 days of concession is also available for ILR application too, may be there won't be any shortfall if you apply after 1st July.

Sorry I didn’t mean to post twice it was just because the first post didn’t say July 1st and I couldn’t edit it so I posted again including July 1st.

When my wife applied for me to first come she had to call someone to the house to show that there was enough living space in the house for me on an official letter. The letter stated how many bedrooms and how many people lived at the house and there would be sufficient space for me. I cannot find any information regarding whether this is needed to be done again for the visa extension?

That was an housing inspection report towards your initial spouse visa application I presume. At this point for extension, your evidence of cohabitation, tenancy agreement, council tax letter

Required forms and documents

Post by Adnan20161993 » Sun Aug 30, 2020 12:43 am

Hello.
Apologise if this has already been posted, I have tried doing a search. If this has already been posted please could you kindly let me know which topic.

I came to the U.K. in January 2018 and my visa is due to run out this October. I am trying to apply for my extension as a spouse visa. I just wanted to know if I have all the documents required to process or is there anything else required. I would be so grateful if someone could confirm or add.

1) my visa runs out on 10th of October. I have my English test booked for the 10th of September. I have ready this can take 7 days for the certificate to be posted. Would it be best for me to look for a closer date?

2) fill out the online Form which has 7 stages (start, application, finance, documents, declaration, pay, further actions) I have started to fill this in.

2) fill in the paper version of the flr m form.

3) pay for the health surcharge

4) send supporting documents including proof of marriage, income and proof of living together etc.

Is there any other documents I need to fill out?

Thank you for your time.

Topics merged!!

1. The date of the test is fine.

2. Yes, FLR M form online.

3. No. You only complete the online form. You can't apply by paper form anymore.

4. Yes, it is part of the online form process.

5. You have to scan and upload all your documents digitally. Nothing is sent by post to HO.

Hello. I hope someone could help me please. I am trying to fill out the online form for my first visa extension and I was wondering if someone could confirm if these answers were ok as I am trying to save money to do myself without an immigration solicitor.

1) Are there any factors which would make it difficult or impossible for you to integrate and establish a private life in that country?

Answer: YES. It would be difficult as not only is my wife a British citizen, but I also have a child with my wife. He is also a British citizen and living in the U.K., and so on this basis I believe it would be difficult for me to have a private life away from them.

2) Have you ever been refused a visa for any country, including the UK?

Answer: YES.
When I first got married my wife applied for my spouse visa, this was rejected due to financial requirements not believed to have been met. We then reapplied and I was granted my spouse visa and then I entered the UK for the first time.

3) Is this the first time you have applied for a partner route, or an extension, with your current partner (including as a fiancé(e) or proposed civil partner)?

Is this answer no? As I am applying for an extension

4) Could you and your partner live together outside the UK if necessary?

Answer: NO. Because we have a British citizen child who is under 1 years old so he will be raised and educated within the UK.
My wife and I also have jobs in the U.K.

5) What is their annual income before tax for this employment in GBP (£)?

I have a temporary contract and my hours vary from 20-40 hours per week not including over time. So how can I include the annual income? I have not yet worked with the company for a year.

6) I have Had another job within the last 12 months and the same question is asked ( What is their annual income before tax for this employment in GBP (£)?) I only worked this job temporary for 6 months so I do not know the annual income as again my hours varied) so how would I answer this?

7) what I am going to show is I worked October 2019-March 2020 with one company (temporary contract) April 2nd 2020-May 2nd 2020 temp again. May 2020 to date with current ongoing employer. I have not received a p60 from any of these only p45 from the first 2. Do I need to request P60 for these? I have only received p45 not p60.

I would be so grateful if someone could kindly help me with these answers

I have almost completed the online application, just waiting to see if someone would be able to help me with those answers.
My visa expires this October 9th. When I first came to the U.K. I took my fingerprints etc for my biometrics in my country outside the U.K. will I be given the details on how to submit biometrics fingerprints again once the application has been submitted? I have tried going online looking at the UKVCAS Website but can’t book an appointment from there

Likely yes. You will be notified if you have to book an appointment or if you are eligible for biometric reuse. It isn't a choice you can make.

You can only access ukcvas after you have applied online and are directed to the ukcvas portal to upload your documents. Biometrics are still be done in phases till the backlog is cleared.

I don’t suppose you know any of the answers to the other questions I posted? They are the only things left I am struggling with to submit my case
