help please ....British citizenship for under 18 kid not born in UK

Hi, can someone help with following questions please:

i) Kid born in 2005 in Pakistan and at that time neither Father nor mother was British citizen (Father became British in 2009).

Kid now in UK living since 2017 with me and Step Mom ( as i married again)
I became British in 2009 and step mom is on Visa
Kid has got settlement status in UK since 2017
Ex wife Pakistani citizen and living in Pakistan (not relevant i guess for this application)

What option should be selected:

a) Your parent is British by descent and lived in the UK or a British Overseas territory for at least 3 years before you were born
b) Your parent is British by descent and you and your parents (unless they are legally separated) are now living in the UK or a British Overseas territory
c) You were born on or after 13 January 2010 and your parent was serving in the UK armed forces
d) You were adopted abroad by British citizen parents
e) You were born before 1 July 2006 to a British father and your parents were not married
f) One or both of your parents is applying for British citizenship
g) Other - apply at the discretion of the Home Secretary

I thought option e) but I was not British in 2005 and also we were married !!!

Its so confusing, please help

It is option g) for your child, ie. application at discretion under Section 3(1).

e) is NOT relevant as you were NOT British at the time of the child's birth.

Presumably you mean the child has Indefinite Leave to Enter and not a 2.5 year visa.

thank you, Yes, he has Indefinite leave to enter.

Also, my kids passport has expired and i cant apply for new Pakistani passport due to Covid-19 now as the embassies are close. So, what other document can be provided as proof of address/id in UK? Should i apply for Citizen card for kid and that can be used as official form of ID?

Further on, following is required:

1) Proof of *dad's name" parental responsibility for Mr "kid's name".
2) Proof of *mother's name " parental responsibility for Mr "kid's name".
- What proofs are required here and what can be given?

3) A letter of consent from Mr "kids name" parent(s) or legal guardian(s)
- What sort of consent is given? is there any template?

4) If Mr "kid's name" has a passport then provide this with your application. If Mr "kid's name" does not have a passport then you must provide another officially-issued identity document. This could include an official travel document or national identity card.
- Will the expired passport be ok ( explained above).

5) Mr "kid's name" birth certificate (showing details of both parents)

- This will have name of my ex-wife, do i need to attach this? Do you think its a must and i should give ex wife details or am i ok not to attach birth certificate.

note: home office already have birth certificate details when i applied for kid ILR in Pakistan few years back.

It is a requirement. Not submitting it will lead to certain refusal. You may need to submit the same document multiple times for different applications.

Do you have documentation of sole responsibility for the child, generally a court custody judgment?

No, i dont have a court order for child custody. I got the custody with mutual decision after our family meeting. There was no court/police etc involved and it was a simple matter (since i was in Pakistan, different laws and customs).

Do you have any documentary proof of sole responsibility? Without that, the MN1 application may run into rough weather.

Also, does your child have ILR/ILE?

Child has ILE.
For sole responsibility, i will check if i got any document from Pakistan at the time of divorce. thank you

I would have thought if home office granted ILE in past, then they should not refuse on the sole responsibility base !!! but again, its on case worker's discretion, i guess !!!

Nationality is not a part of the immigration process, which ends at ILR/ILE. They are different processes with different requirements under different rules and administered by different teams within the Home Office.

apologies, did not realise the consent form was given at the end of the application :O

With regards to parental responsibility, i don't know what home office wants in particular but i can submit passports, birth certificate and i hope that is enough...
