3c leave

Post by janu17 » Mon May 04, 2020 10:44 pm

Hi All,

Need your valuable advice

I Will finish my 10 years of living in the UK in may 2020

My immigration history in detail

10/06/2010 arrived in the UK
27/06/2012 - 27/06/2014 (PSW)
26/06/2014 applied Tier1 Entrepreneur Visa
12/11/2014 date of application refused with right to appeal
17/11/2014 received refusal decision 3 days later
28/11/2014 appeal lodged ,
25/05/2017 appeal granted

entreprenuer valid till 25/05/2020

Can I still apply for ILR under 10 year route if I am eligible as I am reading about the 3c leaves online .
I am still confused as 3c is continue because my soliciter lodged appeal after 16days of refusal , that time i asked him about why you lodgged appeal late , he said no worries we received on 17th/11.2014 only so no problem, during the time 3 years i worked some the companies , they had checked right to work ,everything was ok, i got positive response from home office every 6 month . i am worried about 3 c, my 3c is continue or broken?

Your suggestions in the above matter is highly appreciated
Thanks in advance

Regards
Kumar

Your lawful residence is intact. However you said you worked for companies under Tier 1E visa. Remember that under Tier 1E visa rules you are NOT allowed to take employment in other companies or provide contract of service (e.g contracting/working in capacity of an employee)

Hi,

I have entrepreneur visa and my wife's and baby have depended visa ,there via is due to expire on 13th July 2020. At present she is in India and due to lockdown and the current situation , she is not able return to the uk ,all flights been cancelled.

- Would it be possible to extend her further leave to remain for short period to come over to the uk from India?
- If so what is the procedure, any extra docs needed, links etc would be really appreaciated

Thanks

They should get a new entry clearance. There is no short period visa

They should apply as PBS dependant visa online and then follow what the system tells them.

@Zimba, are you sure that the child and wife should apply for the PBS dependent visa, given that the OP is going to go down the ILR(LR) route?

I think it may be better to wait for the OP to get ILR(LR) and then for them to apply on the family of a settled person visa.

You are correct. If OP goes for SET(LR) then his family members need family visa and they have to start their ILR clock from scratch

Thank you so much for your response.

I will be eligible to apply for ILR LR soon next month.

I was caught by police doing speeding , didn't given the speed awareness course and been taken straight to 3 points on my license plus the fine(paid on same day).It was on 2012 november, now i have clean licence .

1-Does this need to be decalred on the ILR form? / has any effect on the ILR application?

Entreprenuer visa was refused in 2014 later went to the court , won the appeal after visa has been granted.
In application they asked.
2- Have you ever been visa refused?
what should i response to this question

Thanks
