Advice - Join Spouse Stamp 4 Application

Hello,

Looking for some advice for myself and my fianceé. I am irish citizen and she is non-EEA. During the current covid situation, we have had to amend our plans for our wedding, and push back ceremony until next year. We are planning before that however to get married and get a license in Denmark once their city halls and borders open.

Our plan is for my fianceé to first come to Ireland as a tourist (us citizen - visa free travel) to self isolate, before we go to Denmark to get married. Upon our return, we would be declaring intention to apply for stamp 4 - join spouse. My question is would it be ok for her to arrive in Ireland, leave, and reenter with a change of status? From what I read, it seems like this is ok, but would it be frowned upon by immigration?

Join spouse is an out of country application. You can't do it in country, so your plan doesn't work.

The above comment is incorrect. US citizens do not need to apply for anything in advance.

For OP's fiancee, just be honest when she arrives in Ireland for the first time. Show the immigration officer your plan to get married in Denmark and then come back to live in Ireland. Better have some confirmed bookings (flights, hotel, civil office etc) for your wedding. She should get a short-term visitor permission for her first entry.

And yes she will likely be roasted by immigration, just like most non-EU nationals who do not come here as a tourist. Immigration normally asks for a LOT of documents. But as long as she has all the documents in hand, you have nothing to worry about. Just don't lie and say that she's coming to Ireland to visit as a tourist.

Once you have married and come back, show the immigration officer your wedding certificate, and state the intention of living in Ireland with you. She will be given a stamp that allows her to register with GNIB. You then book an appointment with GNIB, bring all the required documents there to receive her Stamp 4.

The marriage in Denmark will be your main problem.
It's well known that you only need to give one day's notice to get married there and lots of sham marriages happen there as a result.

I agree with the gist of the above. I will add, though, that you cannot currently get an appointment with the ISD Burgh Quay Registration Office, and all GNIB Registration Offices outside Dublin are closed. OP's partner can, however, email bqregofficeapplications@justice.ie and register as long as it is done within the time period specified within the OP's partner's passport (usually 90 days from the date of entry).

Immigration will be mindful of the fact you've married in Denmark, as that is a hallmark of a quick marriage and it just raises questions. Entry refusal is highly unlikely as the spouse of an Irish national but for sure they'll dig around (including searching mobiles and electronic devices).

So just tell the truth, as mentioned in the post above, and all should be fine. You should see that she'll be given a 90 day stamp with "Register" or "Registration - Spouse", or something similar, written in pen by the officer on the stamp. If you fail to register within that time, you'll have to apply to the Spouse of Irish National Unit, and they are frankly a bunch of cu*ts to deal with.

That is grossly incorrect. Non-visa required nationals do not need a visa to come to Ireland under any circumstances. They just need to make sure they have all the documents ready before jumping on a plane.

To join the spouse, they just need a wedding certificate and proof of relationship. To study, they need to have paid in full and have obtained a letter from the college. To work, they need to obtain the employment permit.
