Confusion of Dependants visa after getting ILR

Post by iybutt » Fri Jul 03, 2020 4:04 pm

My T1E (visa expire date december-2020)

I am going to apply ILR in September (Ten year based).

me and my 2-dependants are currently on (Tier 1 Enterp).
Will my dependent legal status changed after i get ILR on ten years bases in September .

and do i have to apply for FLR(FP) (immediately after getting ILR) or i can wait until December when their visa expires?

Thanks
imran

They need to switch to FLR(M) spouse/child visa before their visas expire, even if a decision is still pending on your ILR.

Their 5 year ILR clock will reset to zero and a new 5 year route to ILR (2 x 2.5 year visas).

Note that IHS is increasing in October from £400 per year to £625 per year for each dependent.

hi Cr001,
Thanks for reply.
sorry i forgot to update in my last post. I will go at (priority service) for my IlR (10 year base)
and my dependants has already have 7 years with me. They came in uk 2013. so according my calculation they only need to get only 2.5 years visa in FLR (m) to complete (10 year route)

kindly correct me if i am wrong.
thanks

Maybe two more extensions will be needed (unless the process of application gets delayed triggering section 3C) as there is no 6 months of visa.

Confusion on Dependant Flr(m)

Post by iybutt » Mon Nov 16, 2020 11:54 am

Hi there,

Sponsor Applied ILR (Long Residency) on 15/10/2020.

Currently On Tier 1 (Ent) Extension.
Dependents Visa Expire on 13/12/2020
Income Issue:
Spouse was taking dividends from a Limited company (Sole Director).
Dividends were declared during the year (01/02/2019 To 31/01/2020) of £18000
which he was taking money every month from November 2019 till to date (£2K PM Including this year dividends).
£18K has been declared in the CH & HMRC and appropriate tax returns have been submitted including Director Tax return (2019/2020).
Dependent also work as a Primary teacher and earned £11000 in the 2019/2020 Tax year (P60 Figure).

Questions:
1-Can you claim that in last tax year 19/20 total income was £29K?
2- Some dividend Payments (£10K in 19/20 and £8K in 20/21) were taken in next year although earned in 19/20 and declared in 19/20 in Company & personal Tax returns. Will it be an issue in claiming £29K?

Regards
Imran
