Urgent query - Part time on Tier2

Post by chaplin14 » Thu Jul 23, 2020 3:46 pm

Hi everyone,
I am currently on tier2 general visa (SOC 2211) on maternity leave. I was planning to return to work part time and my sponsor says it is absolutely fine as long as my salary stays above 30K. However I am a bit worried as tier 2 guidance says you should earn at least 30K or appropriate salary for your job whichever is higher (in my case salary for my position is higher than 30K). So I do part time, my salary will be above 30K but below the rate for my job as specified in SOC. Could someone who come across give me some pearls of wisdom as I am very confused please!

You can't work part time on tier 2. You must work a minimum of 30 hours per week. Your salary, based on the SOC, can be prorated to the reduced hours.

Hi CR001,
Thank you so much for your reply. This is what I am planning to do - reduce my hours so I will be working 32 hours per week. If I got you right, it is possible to reduce hours and salary pro rata (will be still above 30), is this correct?

Yes, your employer simply reduces your hours pro rata. As long as the pro rata salary meets the SOC salary which is at normal 39 hours pw, no issues.
