my partner applied (from Brazil) for a Tier 2 General visa back in early March and was sent a refusal letter yesterday due to:
You have been issued the following CoS: Tier 2 (General - Switching Immigration
Category) [A rating].
As you have not been issued a restricted CoS under the Tier 2 (General) limit, you have
not scored 30 points under Appendix A. Your application is refused under paragraph
245HB (b).
Obviously one of the options is to reapply (with the employer actually getting it right this time) as I think the RLMT is just about still valid. All other points were awarded. However her English language certification was only valid until April and no appointments are available for her to sit another test until December.
I'm guessing not, but would like to make sure. Is there any way of reapplying while the RLMT has still been met?
