Hello everyone! :D

Finally my husband has been granted a permanent residency!! We are soooo happy!! :D Thanks to this forum and help from a lot of people on there we managed to.do everything without any lawyers.
It's been a long journey and I know it hasn't quite ended yet because of BREXIT :evil: but getting there.

We wanted to apply for PR before EU settlement so it makes it easier to apply.

I'd like to know of anyone has experience with applying for EU settlement with a permanent resident card under surrender singh?

Here is my timeline:

I moved to Ireland: Feb 2013
Husband followed: Aug 2013
Returned to the UK: Feb 2014 (applied for RC)
Rejected: Nov 2014
Sent reconsideration: Nov 2014
Resident card issued: Dec 2014
Applied for PR: Dec 2019
Rejected (missing docs): June 2019
Sent reconsideration: June 2019
Permanent resident card issued: Aug 2020

I tried to find a PR timeline but I guess it's been deleted?
Moved to Ireland: Feb 13
UK FP: Granted November 13
Ireland RC: Granted Feb 14
Returned to the UK: Feb 14
Applied for EEA2: 18th March 14
EEA2 Rejected: October 14 (re-submitted docs)
EEA2 Granted: December 14 (valid till 2019!)

If your husband has got PR under Surinder Singh route, why not apply directly for British citizenship? There is no need to (a) apply for EU Settlement and (b) wait for a year after PR, as you are a British citizen.

Thank you for replying.

I know we can apply straight away but he's worried that his 10 year immigration history will affect his application.
He's been on an EU visa for 6 years in March 2020.

He used to be on a student visa and was curtailed and then went through a few appeals.
We then applied for spouse visa while his appeal was pending and so they rejected both applications (we didn't know we could apply during a pending appeal). In the end he was told to leave.
We don't believe he's overstayed at all but according to the USA embassy he has overstayed in the UK so he was refused a tourist visa.

Is there a way we can access the information kept on his file at home office? I tried to look for a department to contact for freedom of information.

Any help or advice would be appreciated!

Request personal information held in the borders, immigration and citizenship system

If he has overstayed, it would be indeed be wiser to wait till at least 10 years after the overstay ended. If refused, you do not get a refund on the naturalisation application fee (~£1200).

Thank you for the link!! Let's see what it comes up.
Yes exactly, we are not in a rush so better to wait in case there is an issue we don't know about. And of course wasting so much money.

Does anyone know if we can apply online for the EU Settlement scheme? I know cases based on the surrinder singh route have a paper application but is it possible to do it online now that we have a permanent resident card?
