Stamp 4 to stamp 1 ( temporary 6 months)

Hi All,
I would be glad if you could assist me from yours experience or from someone you know.

Can you request for temperary stamp 1 from inis in order to apply for critical skill work permit, while EUfam visa is revoked and on temporary stamp 4 from review.

What are the chances that inis will give temporary stamp 1 to apply for critical skill work permit . To add my current job falls in critical skill criteria .

That’s not how Stamp 1 works. You apply for the employment permit first, get an approval, then get a Stamp 1.

Apologies if I was not so clear.

You cannot apply for work permit with stamp 4, so you need a permission from inis to apply for work permit . Inis usually gives 6 months temporary stamp 1 and then you apply work permit with department of enterprise

you need to wait for decision of your review, before then that you can't request for the temp stamp 1.. and if you do they will ignore it. only way is clear stamp4 side and then request for stamp 1.

about chances can't say anything as they already revoked your visa because of false marriage suspicion. and its not good sign.

Thanks final version, review decision might take another two years or more to give their final decision. But I thought to write to domestic division to grant me temporary stamp 1 as fall in critical skill criteria, once they give me temporary stamp 1 I’ll waithdraw my review case with eutreary . Do you think if there are any chances in this approach?

I'm in same boat as you.. and I already tried for temp stamp 1.. I worked in tech from last 8 years on critical skill. so telling you from experience.

I visited many solicitors and everyone was giving false hopes.

their response was simple you already have temp stamp 4, and your application is in process. and DBEI can't over rule EU treaty permission. that's why first need to wait for the decision of EU treaty right.

My solicitor said there is no harm applying for temporary stamp 1 in order to apply for work permit, as applying for work permit based on stamp 4 would be a refusal,
So I think it’s worth to give a try

Just to confirm did you applied for temporary stamp 1 and was refused or you haven’t applied based on your solicitor’s advise?

there is difference between applying and requesting.

1. you don't apply temp stamp 1 (there is no way/process to apply temp stamp 1)..
2. you just send letter, request department to issue you temp stamp 1.. and then its on department, they give you OR not..

I request department for temp stamp 1, based on my profile, experience and Tech job. and they didn't give me. hope this answer your question.

Just one more question if you don’t mind. Did you request stamp 1 recently like in 2019 or in 2020. The reason I am asking is that INIS maybe flexible these days due to Covid 19 and may understand our problems.

If your were in any medical field then it's possible they will give you favour OR little flexible in that COVID days..
