Question on ILR application

Dear all;

I became eligible to apply for ILR after completing 5 year on Tier 2 Visa, my current visa expires next August. I have applied for provisional license earlier but DVLA is holding my documents for over a month now; I am afraid it will take a while till DVLA returns my BRP (I called them and I was told processing my provisional driving license application and documents return could take another 4 weeks).
Could you advise if I can apply for BRP replacement?
Also, considering IDV invitations, should I go ahead with ILR application instead of waiting? last time I gave my biometrics 2 years ago when I moved to other job.

You can apply for a BRP replacement only if its lost or stolen.

You can submit your ILR application in the meantime as:

a. You dont need documents to submit the application. You upload them later.
b. You dont need to send physical documents to UKVI. You just upload a scan, this includes passport and BRP.

one more question, if I will be selected for in person biometrics appointment can I go ahead without BRP? or should I wait for BRP to be returned before booking enrolment?

Better to wait until receiving back your BRP (if possible) otherwise any correspondence exchanged from dvla along with proof of posting might be accepted in lieu of it.

is it mandatory to take a picture of BRP through IDV app? or is it specifically for selfie and live test?

can you suggest what kind of documents in relation to absences from the UK can I provide for my spouse? She is not working thus no employer can provide a letter for support

No evidence other than passport(s) are required. Note also that there is NO absence limit for a PBS Dependent for the time on visas held before 11th January 2018. If they have a visa issued on or after 11th January 2018, you only have to declare the absence since that visa was issued.

one more clarification please? should I include evidence that shows we have lived together for up to a maximum of 2 years? last VISA were issued in Nov 2018 after I changed an employer.

Yes, this is mandatory to prove subsisting relationship. You need evidence for 2 years immediately preceding the date of application, from 3 to 6 difference sources, spread evenly for every 3 to 4 months, in either joint names or addressed to each of you individually. NOTE : the generic checklist does not list this, but is is mandatory as the immigration rules and guidance state you are required to prove subsisting relationship.
last VISA were issued in Nov 2018 after I changed an employer.
Only absences since this was grant date needs to be provided.

my BRP was issued on 18 Sept, but my start date at work was 21 Sept, should I consider 21 September as a start date for my 5 year eligibility period?

Tier 2 general ILR qualifying period starts from the initial visa issue date.

would employer support letter and letter on absences (dates out of UK on vacation + any business related absences from UK) be sufficient to prove 5 year continuous residence? Or should I provide bank statements + council tax bills + tenancy agreements for full 5 year period?

thanks for clarifying, in the documents part, under "Other Documents" I have tick-mark to provide "Evidence of Mr XXXX XXXXXXXX immigration status in the UK", What kind of document can I provide here? current BRP?

Dear all;

One more question on Consent for the Home Office to verify application information please:
I am main applicant and I added my dependant to the application as well, we have joint utility bills that I am providing to home office. Should I as the main applicant sign Part 1 of the consent form and dependant sign Part 2 of the consent form? Or should we both sign Part 1 only?
