Spouse Visa Appeal Process

Post by Ciklet » Mon Sep 14, 2020 10:51 am

Hi All,

I got refused and appealed to visa for spouse of EU citizen in July 2020. We are still waiting for a reply to my appeal.
Has anyone got an answer to their visa appeal recently or anyone still waits for the reply?

Thank you,

I'd expect you to be waiting another 6-8 weeks.

On what grounds was it refused?

Not for spouse of EU. Spouse of Irish national or non-EU possibly.

So, as I said NOT SPOUSE OF EU. Why are you posting on a thread about Spouse of EU, if you are not and have nothing useful to add?

@Granista... why are you so rude?

@Ciklet, my very close friend appealed 26th June, still waiting. Received only a letter of receipt of their appeal.

It's rude for a poster to pretend to have information to add when they don't.
It's like if someone wants to know if its raining in Dublin, and you keep talking about the weather in Cork. It's irrelevant. It's of no use to anyone.

On what grounds was it refused?

@Granista I hope we will get a reply within 6-8 weeks then. One more question, how did you come up with that date? According to any previous case or just prediction?
Our visa refused due to not provide original marriage certificate (we provided our local marriage certificate but it wasn't counted as it was not attested by the issuing country’s Ministry of Foreign Affairs) and cannot prove my husband is exercising Free Movement Right (we couldn't prove some documents due to his new arrival to the country) - To sum, it can be said that due to insufficient documents.

Moreover, I didn't also know that our visa type's (spouse of EU citizen) processing dates are different from the spouse of Irish and CAT A.

@Dbs123 May 2019 seems very long. May I ask you why their visa had refused? I hope you and your friend get your approvals soon.

@White_Pearl At least they received a letter. I had to wait 3 weeks to get an answer to my email to be sure whether my documents have arrived or not. Thank you for sharing.

Spouse of Irish National visas are longer than EU family visas. The EU law basically fast tracks everything related to immigration permission and visas, where as visas for Irish national spouses are dealt with on domestic law grounds.
